Sustaining Natural and Working Lands

Messrs. Tarr and O'Connor moved that the proposed new text be amended by inserting after section ____ the following sections:-  

"SECTION ___. Chapter 21N is hereby amended by inserting at the following new section:-

SECTION 12. (a) The executive office of energy and environmental affairs shall develop policies, programs, grants, loans and incentives to meet the statewide natural and working lands goal as identified in the plan, including, but not limited to, a communities for a sustainable climate program. The executive office of energy and environmental affairs shall apply and disburse monies and revenues as provided in this section.

(b) The secretary shall establish a communities for a sustainable climate program. The purpose of the program shall be to provide technical and financial assistance, including incentives, grants and loans, to municipalities that qualify as sustainable communities under this section. These incentives, grants and loans shall be used to finance all or a portion of the costs of designing, constructing and implementing actions and strategies to reduce greenhouse gas emissions and increase carbon sequestration on natural and working lands.

(c) To qualify as a community for a sustainable climate, a municipality or other local governmental body shall comply with eligibility requirements developed by the secretary or his designee. Eligibility requirements are intended to incentivize communities to adopt policies and practices that protect, enhance, and restore carbon stocks on natural and working lands beyond business as usual. The secretary shall set eligibility requirements from among, but not limited to, the following: (1) adopt a municipal tree retention and replacement by-law or ordinance; (2) adopt natural resource protection zoning, as defined by the secretary; (3) collect a reasonable fee to be used exclusively for measures to remedy and offset the generation of greenhouse gases caused by activities that convert forest, wetlands, and agricultural lands for development at a size and scale determined by the secretary; (4) adopt a municipal transfer of development rights by-law or ordinance; and (5) adopt and implement a municipal procurement policy for municipal purchasing and substituting wood products for municipal operations and assets, where feasible, including but not limited to, concrete and steel in buildings. The secretary may waive specified requirements based on a written finding that, due to unusual circumstances, a municipality cannot reasonably meet the requirements and that the municipality has committed to alternative measures that advance the purposes of the communities for a sustainable climate program as effectively as adherence to the requirements. The Secretary may adopt alternative eligibility requirements that provide opportunities to achieve the goals of the program.

(d) The secretary may develop policies to provide for consistency and predictability and to help offset the impacts of municipal ordinances and by-laws upon the private sector under the communities for a sustainable climate program that may be adopted by participating communities, including, but not limited to, grants, loans, incentives and tax credits and expedited permitting for practices and strategies consistent with the goals to reduce greenhouse gas emissions and increase carbon sequestration on natural and working lands.

(e) Funding for the communities for a sustainable climate program in any single fiscal year shall be available, without the need for further appropriation, from sources including, but not limited to: (1) the global warming solutions trust fund established in section 35GGG of chapter 10 of the general laws; and (2) land management and restoration grant, loan and incentive programs administered by the executive office of energy and environmental affairs."

Low-Income Services Solar Program

Messrs. O'Connor, Tarr, Feeney and Pacheco moved that the proposed new text be amended inserting the following section:-

"SECTION XX. Chapter 29 of the General Laws is hereby amended by striking out section 2LLLLL, as enacted by section 54 of chapter 8 of the Acts of 2021 and amended by section 21 of chapter 126 of the Acts of 2022 and by section 15 of chapter 2 of the Acts of 2023, and inserting in place thereof the following section:

Section 2LLLLL. There is hereby established and set up on the books of the commonwealth a separate, non-budgeted special fund to be known as the low-income services solar program, which shall be administered by the department of energy resources. There shall be credited into the fund revenues or other financing sources directed to the fund by appropriation or other monies authorized by the general court and specifically designated to be credited to the fund, any income derived from the investment of amounts credited to the fund and monies from the repayment of loans from the fund, funds from public or private sources including, but not limited to, gifts, federal, state, or private grants, donations, rebates and settlements received by the commonwealth that are specifically designated to be credited to the fund and all other amounts credited or transferred into the fund from any other source. The department shall establish a grant program to provide solar energy technology to non-profit organizations offering services including, but not limited to, food security, homelessness and emergency shelter; provided, that any such grant shall be expended for solar energy technology at the principal place of the non-profit organization’s operations or at any location or site that has a primary or secondary function to provide benefits or services, including, but not limited to, satellite operations space or affiliated organization locations; provided further, that 100 per cent of the solar energy produced by said technology will benefit the awarded non-profit organization. The amounts credited to the fund shall be available for expenditure, not subject to appropriation, for the costs associated with purchasing and installing solar energy generating equipment for non-profit organizations that meet criteria set forth by the department; provided, that not less than 10 grants shall be awarded per fiscal year; provided further, that no grant amount shall exceed $50,000; and provided further, that grants shall be awarded in geographically diverse areas of the commonwealth. The department shall annually submit a report on disbursements of the fund, including, but not limited to, grant awardees and amounts awarded, to the clerks of the house and senate and the joint committee on telecommunications, utilities and energy not later than December 31."

Anaerobic Digester Incentive Program

Messrs. Finegold, Tarr, Brady and O'Connor moved that the proposed new text be amended by inserting after section 53 the following section:-

“SECTION 53A. Subsection (e) of section 17 of chapter 25A of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by striking the first sentence and inserting in place thereof the following sentence:-

Anaerobic digestion biogas-to-energy and landfill gas-to-energy facilities, referred to in this subsection as “anaerobic digestion facilities”, that are located in the commonwealth and are both operational and qualified as Class 1 renewable energy generating sources pursuant to section 11F prior to November 7, 2021 shall be eligible for an incentive program via a 1-time procurement for Class 1 renewable certificates which are generated by existing anaerobic digestion facilities.”

Ms. Rausch and Mr. O'Connor moved that the proposed new text be amended in section 2, in item 2200-0107, by inserting the following words:- "; provided further, that not less than $250,000 shall be expended to the department of environmental protection, in coordination with the department of agricultural resources, to develop and administer a grant program to small businesses located in the commonwealth to implement composting; provided further, that grant monies may be used by grantees to obtain compost collection containers, procure educational or technical assistance, establish regular collection of food waste and other compostable matter, or other similar composting efforts or activities; provided further; that the department of environmental protection shall open the grant application process and issue relevant instructions not later than August 15, 2023, applications shall be submitted not later than September 30, 2023, and grantees shall be selected not later than November 15, 2023; provided further, that agricultural businesses and food service establishments shall be prioritized in the grant application review process; and provided further, that not later than March 31, 2024, the department of environmental protection, in coordination with the department of agricultural resources, shall submit to the senate and house committees on ways and means and the joint committee on environment and natural resources a report on the implementation of the grant program, including without limitation the names and locations of the grantees, the number of pounds of food waste and other compostable matter collected, and information about where the waste was diverted”; and by striking out the figure “$499,997” and inserting in place thereof the following figure:- "$749,997".

Circular Economy Grant Program

Ms. Moran moved that the proposed new text be amended by adding the following section:-

SECTION X. Chapter 21 of the General Laws is hereby amended by adding, after section 67, the following section:-

Section 68. The Massachusetts Department of Environmental Protection shall establish a competitive grant program to provide funding to Massachusetts small businesses for the transition to a circular economy. Circular economy is defined as an economy that keeps material, products, and services in circulation for as long as possible. The department shall promulgate regulations to support the creation of the program. The department shall be authorized to accept applications from businesses that are incorporated in, are properly licensed to do business in, or have a location in Massachusetts. All grants made under this program should provide a measurable economic benefit to Massachusetts.

The department shall evaluate a list of criteria in awarding grant applications. The Department shall prioritize applications that fall under any of the following categories: applications that are from (i) certified minority-owned and women-owned business enterprises; (ii) businesses that are geographically located within an environmental justice population; and (iii) businesses that provide substantial benefit to environmental justice populations, as long as these applications meet all other necessary criteria. Environmental justice populations are defined in section 56 of chapter 8. The department is authorized to use its discretion to decide between applications of similar standing.

Blue Technology Grant Program

Ms. Moran and Messrs. Tarr and Cyr moved that the proposed new text be amended by adding the following section:-

SECTION X. Chapter 21A of the General Laws is hereby amended by adding, after section 28, the following section:-

Section 29. The Secretary of Energy and Environmental Affairs shall establish a grant program to provide funding to Massachusetts non-profits, academic institutions, and businesses to conduct scientific research and the research and development of new technology created for the purpose of improving ocean health and the responsible use of the ocean. This funding may be used for scientific studies and other research, research and development of new technology, investment into existing beneficial technology, expansion of existing beneficial technology, or research into how the technology affects the Commonwealth, the state economy, or particular industries. The department shall promulgate rules and regulations to support the creation of a grant program. The department shall accept applications from entities that are incorporated in, are properly licensed to do business in, or have a location in Massachusetts. All grants made under this program should provide a measurable economic benefit to the Massachusetts ocean economy.

In awarding grant funding, the Secretary shall prioritize projects with the most measurable benefit to the ocean environment, marine species, or coastal communities; projects using existing technology that is identified as the best available prototype in the field; projects with outcomes that promote equity and inclusivity; projects that promote the use of time-series data. Applications that satisfy one or more of these criteria shall be considered favorably in priority of awards for funding, so long as those applications meet all other necessary criteria. The Secretary is authorized to use her discretion to decide between applications of similar standing.

Wastewater Treatment Plant Upgrade Program

Ms. Moran and Mr. Tarr moved that the proposed new text be amended in section 2, in item 1599-0093, by adding the following words:- “; provided, that funding may be expended to the department of environmental protection to establish a grant program to provide funding to upgrade wastewater treatment plants to accommodate affordable housing developments; provided further, that eligible grantees shall include any person, entity, or state agency that owns or operates a wastewater treatment plant or modular wastewater treatment system whose sewer load would expand beyond the plant’s maximum rated load capacity by serving future residents of a housing development proposal that has been approved by a municipality or the commonwealth under sections 20 to 23 of chapter 40B of the General Laws; provided further, that funding distributed from the program shall not be used for any other purpose besides physical upgrades to said wastewater treatment plant or modular wastewater treatment system or to expand operational capacity for management of said plant or system and shall not exceed 100 thousand dollars”.

Old Harbor Reservation

Mr. Collins moved that the proposed new text be amended by inserting after section 7, the following section:-

“SECTION 7A. Chapter 10 of the General Laws is hereby amended by striking out section 35III, as appearing in the 2020 Official Edition, and inserting in place thereof the following section:-

Section 35III. There shall be established and set up on the books of the commonwealth a separate, non-budgeted special revenue fund known as the Old Harbor Reservation Trust Fund, which shall be administered by the department of conservation and recreation. Amounts credited to the fund shall be expended, without further appropriation, for the purposes of advancing recreational, educational, conservation, public health and safety interests, including, but not limited to, dedicated environmental police and ranger staffing, maintenance staff, construction and maintenance of facilities and infrastructure improvements, of the Old Harbor reservation area, including, but not limited to, Castle Island, Pleasure bay, McDonough sailing center, Marine park, Murphy memorial skating rink, M street beach, Carson beach, Day boulevard and Columbia road, in the South Boston section of the city of Boston.

The fund shall receive, hold and expend all fees generated by permits, licenses and all other agreements not currently directed to the General Fund relating to the use of the aforementioned Old Harbor reservation assets, facilities and land as authorized by the department. Any unexpended balance in the fund at the end of a fiscal year shall remain available for expenditure in subsequent fiscal years. Annually, not later than July 31, the department shall submit a report, which shall include, but shall not be limited to, an accounting of all funds generated for the trust and expenditures for the previous fiscal year, to the house and senate committees on ways and means. The department shall not make expenditures from this fund so as to cause the fund to be deficient."; and

by inserting after section 53 the following section:-

“SECTION 53A. Notwithstanding any general or special law to the contrary, any funds previously transferred to or existing in the Castle Island and Marine Park Trust Fund shall be transferred to the Old Harbor Reservation Trust Fund established under section 7A.”.

Veteran's Halls Solar Program

"SECTION __ Section 2 of Chapter 29 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by adding the following section:-

Section 2RRRRR.

(a)  As appearing in the following section the following word shall, unless the context clearly requires otherwise, have the following meaning:

“Veterans’ organization”, any veterans' organization incorporated by the Congress of the United States.

(b) There is hereby established and set up on the books of the commonwealth an expendable trust to be known as the veterans hall solar program. The secretary of energy and environmental affairs shall establish a grant program to provide solar energy technology to Veterans organizations, that any such grant shall be expended for solar energy technology at the local Veteran's organization's location, hall, or post; provided further, that 100 per cent of the solar energy produced by said technology will benefit the awarded local Veterans organization. The amounts credited to the trust shall be available for expenditure, subject to appropriation, not to exceed $500,000 in a fiscal year, for the costs associated with purchasing and installing solar energy generating equipment for Veterans organizations that meet criteria set forth by the secretary; provided, that not less than 10 grants shall be awarded per fiscal year; provided further, that no grant amount shall exceed $50,000; and provided further, that grants shall be awarded in geographically diverse areas of the commonwealth.

(c) The executive office of energy and environmental affairs shall annually submit a report on disbursements of the trust, including, but not limited to, grant awardees and amounts awarded, to the clerks of the house and senate and the joint committee on telecommunications, utilities and energy not later than December 31."; and

By inserting, in section 2, after item 1595-6232 the following item:

“xxxx-xxxx For the executive office of energy and environmental affairs to distribute in a manner consistent with the recommendations of the veterans hall solar program established under section __ of this act…………………….$500,000”

Water Protection Commission

"SECTION 53A. (a) There shall be a special commission to examine the potential environmental and economic impacts caused by the discharge of spent nuclear fuel pool water or other wastewater with both radiological and other pollutants associated with the decommissioning of any nuclear power plant into the waters of the commonwealth. For the purposes of this section, “waters of the commonwealth” shall include all waters under the jurisdiction of the division of marine fisheries, including, but not limited to, bays, coastal waters, canals, rivers and streams.

(b) The commission shall consist of: the governor or a designee; the secretary of energy and environmental affairs or a designee, who shall serve as chair; the secretary of health and human services or a designee; the senate president or a designee; the speaker of the house of representatives or a designee; the minority leader of the senate or a designee; the minority leader of the house of representatives or a designee; the chairs of the joint committee on environment and natural resources or their designees; the commissioner of environmental protection or a designee; the commissioner of public health or a designee; the executive director of travel and tourism or a designee; the commissioner of the department of fish and game or a designee; and 5 members appointed by the governor, 1 of whom shall be a scientist with expertise in marine radiochemistry, 1 of whom shall be a scientist with expertise in physical oceanography, 1 of whom shall be a scientist with expertise in health physics, 1 of whom shall be a scientist with expertise in nuclear chemistry and 1 of whom shall be a scientist with expertise in chemical oceanography.

(c) The commission shall: (i) examine and investigate the potential environmental and economic impacts, including impacts to consumer perception of the discharge of spent nuclear fuel wastewater or other wastewater with both radiological and other pollutants on the fishing, aquaculture, tourism and restaurant industries and any other sectors deemed appropriate by the commission; and (ii) make recommendations on measures to mitigate or avoid potential negative impacts on such industries.

(d) The commission shall hold not less than 4 listening sessions, with at least 1 listening session in each of the following counties: Dukes, Plymouth, Bristol and Barnstable; provided, however, that upon the completion of its report under this section, the commission shall provide a public presentation in said counties. Not later than November 1, 2025, the commission shall file a report on the results of its study with the clerks of the house of representatives and the senate, the joint committee on environment and natural resources, the joint committee on public health, the joint committee on tourism, arts and cultural development, the joint committee on economic development and emerging technologies and the senate and house committees on ways and means.

(e) The department of environmental protection shall not approve any surface water discharge permit application related to the discharge of spent nuclear fuel pool water or other wastewater with both radiological and other pollutants associated with the decommissioning of any nuclear power plant into the waters of the commonwealth until 30 days after the submission of the commission’s report pursuant to subsection (d).".

"SECTION X. SECTION X. Said section 96 of said chapter 164 is hereby further amended, in said subsection (b), by inserting after the words “customer service.” the following words:- “In addition, the department shall approve and require adherence to a legally binding decarbonization plan that is compliant with the emissions limits and sublimits established pursuant to section 3 of chapter 21N and consistent with any roadmap plan published pursuant to said section 3 of said chapter 21N.”

SECTION X.
