Conservation Land Tax Credit

Messrs. Tarr, Eldridge, Gomez, Payano, O'Connor, Timilty, Fattman and Keenan moved that the proposed new text be amended by inserting after section _ the following sections:-

"SECTION 1. Section 6 of chapter 62 of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by inserting after the word “amended”, in line 769, the following words:- , or a private nonprofit trust established pursuant to chapter 203 organized for the purposes of land conservation, which is authorized to do business in the commonwealth, and which has tax-exempt status as a nonprofit charitable organization as described in section 501(c)(3) of the Internal Revenue Code of 1986, as amended.

SECTION 2. Said section 6 of said chapter 62, as so appearing, is hereby further amended by striking out, in line 835, the figure “$2,000,000” and inserting in place thereof the following figure:- $3,000,000.

SECTION 6. Section 38AA of chapter 63, as so appearing, is hereby amended by inserting after the word “amended”, in line 29, the following words:- , or a private nonprofit trust established pursuant to chapter 203 organized for the purposes of land conservation, which is authorized to do business in the commonwealth, and which has tax-exempt status as a nonprofit charitable organization as described in section 501(c)(3) of the Internal Revenue Code of 1986, as amended.

SECTION 7. Said section 38AA of said chapter 63, as so appearing, is hereby further amended by striking out, in line 88, the figure “$2,000,000” and inserting in place thereof the following figure:- $3,000,000.

SECTION 8. Said section 38AA of said chapter 63 is hereby further amended by striking out the figure “$3,000,000”, inserted by section 7, and inserting in place thereof the following figure:- $4,000,000.

SECTION 9. Said section 38AA of said chapter 63 is hereby further amended by striking out the figure “$4,000,000”, inserted by section 8, and inserting in place thereof the following figure:- $5,000,000.

"SECTION_. Section 1A of chapter 130 of the General Laws is hereby amended by adding after the fourth sentence the following:

Notwithstanding any general or special law to the contrary, but subject to chapter 130, the division of marine fisheries shall have the sole authority and jurisdiction in the commonwealth to regulate the harvest of marine fish and the effect of such activities on marine fish species and marine fisheries resources, and no person authorized to engage in fishing activities by the division pursuant to chapter 130 shall be required to file a notice of intent pursuant to section 40 of chapter 131 or a local wetlands bylaw or regulation, or obtain a permit or license pursuant to chapter 91 or a water quality certification pursuant to chapter 21 in relation to such fishing activities."

Biodiversity Trust Fund

Messrs. Moore, Eldridge, Tarr, Payano and O'Connor moved that the proposed new text be amended by inserting after section __ the following section:-

"SECTION __.  Chapter 10 of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by adding after section 35D the following section:-

Section 35D1/2.  There shall be established and set up on the books of the commonwealth a separate trust fund to be known as the Biodiversity Trust Fund, which shall be administered by the commissioner of the department of fish and game. There shall be credited into the trust fund revenues or other financing sources directed to the trust fund by appropriation or other monies authorized by the general court and specifically designated to be credited to the trust fund, any income derived from the investment of amounts credited to the trust fund, and funds from public or private sources including, but not limited to, gifts, federal, state, or private grants, donations, bequests, rebates and settlements received by the commonwealth that are specifically designated to be credited to the trust fund and all other amounts credited or transferred into the trust fund from any other source.

The amounts credited to the trust fund shall be expended, without further appropriation, as determined by said commissioner as appropriate to carry out the policies, programs, or authorities of said department for the protection and maintenance of biodiversity and natural systems, including, but not limited to, acquisition of land and interests therein; habitat and species connectivity and habitat and species status; anticipated shifts in species distribution and abundance; blue carbon strategies; habitat management, conservation, and restoration; public engagement; data collection; technical assistance; a grant program for said purposes to nonprofit organizations, researchers, and community-based organizations; and associated costs in the commonwealth.

Any unexpended balance in the trust fund at the end of a fiscal year shall remain in the trust fund available for expenditure in subsequent fiscal years and shall not revert to the General Fund. The state treasurer shall not deposit said revenues in or transfer said revenues to the General Fund or any other fund other than the Biodiversity Trust Fund. The commissioner of the department of fish and game shall not make expenditures from this trust fund or take any other action so as to cause the trust fund to be deficient at any point during the fiscal year. The state treasurer shall receive and deposit all revenues transmitted to the state treasurer under the provisions of this section in such manner that will ensure the highest rate of interest available consistent with the safety of the fund, and in an account from which amounts may be withdrawn at any time without penalty for such withdrawal, all interest accrued shall be deposited into the fund."

Biodiversity Trust Fund

Messrs. Moore, Eldridge, Tarr, Payano and O'Connor moved that the proposed new text be amended by inserting after section 9 the following section:-

“SECTION 9A. Said chapter 10 is hereby further amended by inserting after section 35D the following section:-

Section 35D1/2. (a) There shall be established and set up on the books of the commonwealth a separate, non-budgeted special revenue fund known as the Biodiversity Fund, which shall be administered by the commissioner of fish and game. The fund shall be credited with: (i) appropriations or other money authorized or transferred by the general court and specifically designated to be credited to the fund; (ii) funds from public and private sources specifically designated for the purposes of this section, including, but not limited to, gifts, grants, donations, rebates and settlements received by the commonwealth; and (iii) income derived from the investment of money credited to the fund. Amounts credited to the fund shall be expended without further appropriation. The unexpended balance in the fund at the end of a fiscal year shall remain available for expenditure in subsequent fiscal years. No expenditure made from the fund shall cause the fund to be in deficit at any point.

(b) The commissioner may expend money from the fund to carry out the policies, programs or authorities of the department for: (i) the protection and maintenance of biodiversity and natural systems, including, but not limited to, the acquisition of land and interests therein; (ii) work related to habitat and species connectivity and habitat and species status; (iii) addressing anticipated shifts in species distribution and abundance; (iv) blue carbon strategies; (v) habitat management, conservation and restoration; (vi) public engagement; (vii) data collection; (viii) technical assistance; (ix) a grant program for said purposes to nonprofit organizations, researchers and community-based organizations; and (x) any costs associated with said purposes.

(c) Annually, not later than November 1, the commissioner shall file a report on the fund’s activities with the clerks of the senate and house of representatives, the senate and house committees on ways and means and the joint committee on environment and natural resources. The report shall include, but not be limited to: (i) the source and amount of funds received; (ii) the amounts distributed and the purpose of expenditures from the fund, including any grants provided to nonprofit organizations, researchers and community-based organizations; and (iii) a plan detailing the planned uses of funds in the following calendar year.”.

Sustaining Natural and Working Lands

Messrs. Tarr and O'Connor moved that the proposed new text be amended by inserting after section ____ the following sections:-  

"SECTION ___. Chapter 21N is hereby amended by inserting at the following new section:-

SECTION 12. (a) The executive office of energy and environmental affairs shall develop policies, programs, grants, loans and incentives to meet the statewide natural and working lands goal as identified in the plan, including, but not limited to, a community for a sustainable climate program. The executive office of energy and environmental affairs shall apply and disburse monies and revenues as provided in this section.

(b) The secretary shall establish a communities for a sustainable climate program. The purpose of the program shall be to provide technical and financial assistance, including incentives, grants and loans, to municipalities that qualify as sustainable communities under this section. These incentives, grants and loans shall be used to finance all or a portion of the costs of designing, constructing and implementing actions and strategies to reduce greenhouse gas emissions and increase carbon sequestration on natural and working lands.

(c) To qualify as a community for a sustainable climate, a municipality or other local governmental body shall comply with eligibility requirements developed by the secretary or his designee. Eligibility requirements are intended to incentivize communities to adopt policies and practices that protect, enhance, and restore carbon stocks on natural and working lands beyond business as usual. The secretary shall set eligibility requirements from among, but not limited to, the following: (1) adopt a municipal tree retention and replacement by-law or ordinance; (2) adopt natural resource protection zoning, as defined by the secretary; (3) collect a reasonable fee to be used exclusively for measures to remedy and offset the generation of greenhouse gases caused by activities that convert forest, wetlands, and agricultural lands for development at a size and scale determined by the secretary; (4) adopt a municipal transfer of development rights by-law or ordinance; and (5) adopt and implement a municipal procurement policy for municipal purchasing and substituting wood products for municipal operations and assets, where feasible, including but not limited to, concrete and steel in buildings. The secretary may waive specified requirements based on a written finding that, due to unusual circumstances, a municipality cannot reasonably meet the requirements and that the municipality has committed to alternative measures that advance the purposes of the communities for a sustainable climate program as effectively as adherence to the requirements. The Secretary may adopt alternative eligibility requirements that provide opportunities to achieve the goals of the program.

(d) The secretary may develop policies to provide for consistency and predictability and to help offset the impacts of municipal ordinances and by-laws upon the private sector under the communities for a sustainable climate program that may be adopted by participating communities, including, but not limited to, grants, loans, incentives and tax credits and expedited permitting for practices and strategies consistent with the goals to reduce greenhouse gas emissions and increase carbon sequestration on natural and working lands.

(e) Funding for the communities for a sustainable climate program in any single fiscal year shall be available, without the need for further appropriation, from sources including, but not limited to: (1) the global warming solutions trust fund established in section 35GGG of chapter 10 of the general laws; and (2) land management and restoration grant, loan and incentive programs administered by the executive office of energy and environmental affairs."

Codifying HIP

"SECTION X_. Chapter 128 of the General Laws is hereby amended by inserting after section 2E the following section:-

Section 2F. (a) The department of transitional assistance, in partnership with the department of agricultural resources and the department of public health, shall operate a healthy incentives program. The program shall provide that Supplemental Nutrition Assistance Program benefits, established pursuant to the Food and Nutrition Act of 2008, 7 U.S.C. section 2011 hereinafter referred to as SNAP, redeemed for fruit and vegetable purchases, either fresh, canned, dried or frozen, by a SNAP recipient at a participating vendor, shall entitle the recipient to receive a matching benefit reimbursed on the recipient’s EBT card, within limits to be established by the department.

(b) There shall be established and set up on the books of the commonwealth a separate fund, to be administered by the commissioner of the department of transitional assistance, which shall be known as the Massachusetts Healthy Incentives Fund. The Fund shall consist of all revenues from public and private sources as appropriations, gifts, grants, donations, reimbursements from the federal government and grants-in-aid or other receipts to further the purposes of the Fund in accordance with this section.

(c ) The Department of Transitional Assistance and its partners may apply for any available federal programs such as Gus Schumacher Nutrition Incentive Program administered by the United States Department of Agriculture to provide matching benefits to be deposited in the Fund.

SECTION 2. The Department of Transitional Assistance shall promulgate rules and regulations to implement the program set forth in section X.”

The amounts credited to the trust shall be available for expenditure, subject to appropriation, not to exceed $500,000 in a fiscal year, for the costs associated with purchasing and installing solar energy generating equipment for Veterans organizations that meet criteria set forth by the secretary; provided, that not less than 10 grants shall be awarded per fiscal year; provided further, that no grant amount shall exceed $50,000; and provided further, that grants shall be awarded in geographically diverse areas of the commonwealth.

The per-delivery assessment shall be as follows: (i) a food delivery shall have a per-delivery assessment of $0.20; and (ii) a goods delivery shall have a per-delivery assessment of $0.50; (iii) alcohol and marijuana shall have a per-delivery assessment of $1.40 and provided further, that the per-delivery assessment shall be based upon the pre-arranged delivery, as offered by the delivery network company and  selected by the consumer. Section 2MMMMM. (a) The Transit Authority Fund under Section 23 of this Chapter shall be credited any monies transferred under section 12 of chapter 159A and all monies credited to or transferred to the fund from any other fund or source. Castle Island Marine Park Trust Fund

Mr. Collins moved that the proposed new text be amended by inserting after section XX the following section:-

"SECTION XX.  The Castle Island and Marine Park Trust shall receive, hold and expend funds in fiscal year 2025 subject to Chapter 10 of Section 35III furthermore fees generated by permits, licenses, fees and fines on all other agreements relating to the use of the Old Harbor reservation assets, facilities and land as authorized by the department; provided further not less than $50,000 shall be allocated to the department of Massachusetts State Police Troop H for dedicated patrols at Castle Island and Pleasure Bay, including but not limited to, the community action team and mounted unit; provided further that not less than $50,000 shall allocated to the Boston Fire Department for dedicated patrols off Castle Island, M Street and Carson Beaches; provided further that not less than $25,000 shall be allocated for dedicated patrols for Rangers or emergency medical service details at Castle Island; provided further not less than $75,000 shall be allocated for the Harry McDonough Sailing Program for the operation of free public summer youth sailing instruction program; provided further that not less than $10,000 shall be allocated to South Boston Youth Hockey League for a new Little Rink scoreboard at the Francis L. Murphy Memorial Skating Rink; provided further that not less than $40,000 shall be allocated to to South Boston youth sports programs for lighting costs and landscaping at Evans Field.

Castle Island Marine Park Trust Fund

Mr. Collins moved that the proposed new text be amended by inserting after section 9 the following section:-

“SECTION 9A.  Section 35III of said chapter 10, as so appearing, is hereby amended by striking out the first paragraph and inserting in place thereof the following paragraph:-

There shall be established and set up on the books of the commonwealth a separate, non-budgeted special revenue fund known as the Castle Island and Marine Park Fund. Amounts credited to the fund shall be expended, without further appropriation, for the long-term preservation, maintenance, nourishment and public safety of Castle Island and Marine park in the South Boston section of the city of Boston. The fund shall be credited with: (i) any revenues or other financing sources directed to the fund by appropriation; (ii) money authorized by the general court and specifically designated to be credited to the fund; (iii) any income derived from the investment of amounts credited to the fund or repayment of loans from the fund; (iv) funds from public or private sources including, but not limited to, gifts, federal or private grants, donations, rebates and settlements received by the commonwealth that are specifically designated to be credited to the fund; and (v) all other amounts credited or transferred to the fund from any other source. The fund shall be administered by the secretary of energy and environmental affairs.”.
