Amendment #405 to H4000

An Act relative to preventing the ban on gas cars by 2035

Mr. Lombardo of Billerica moves to amend the bill by adding the following new outside section:-

 

SECTION XX. Notwithstanding any general or special law to the contrary, including but not limited to Chapter 21N of the General Laws and 310 CMR 7.40, the Commonwealth shall not adopt, implement, or enforce any motor vehicle emissions standards or requirements that are based on or derived from the California Air Resources Board’s Advanced Clean Cars II regulations, unless such standards have been individually reviewed, approved, and enacted by the General Court.

 

SECTION XXA. The Department of Environmental Protection shall not promulgate or enforce any regulation that requires a specific percentage of new passenger vehicles sold in the Commonwealth to be zero-emission vehicles, as defined by California’s Advanced Clean Cars II program, without explicit legislative authorization.

 

SECTION XXB. Any existing regulations or provisions that mandate adherence to California’s Advanced Clean Cars II standards are hereby nullified and shall have no force or effect.

 

SECTION XXC. This section shall take effect immediately upon its passage.
