Amendment #33 to H4187

Mr. Day of Stoneham moves to amend the bill in section 9, by striking out lines 251 through 258, inclusive, and inserting in place the following: 

Section 332. No product containing any cannabinoid shall be sold or otherwise transferred in the commonwealth; provided, however, that the following products may be sold or otherwise transferred in the commonwealth: (i) prescription drugs as defined in section 1 of chapter 94C; (ii) food ingredients generally recognized as safe by the U.S. Food and Drug Administration; (iii) marijuana and marijuana products sold pursuant to chapter 94G; (iv) seeds of the plant Cannabis sativa L.; (v) hemp beverages and hemp beverage products sold pursuant to chapter 94G; (vi) consumable CBD products sold pursuant to chapter 94G; (vii) industrial hemp sold pursuant to chapter 128; and (viii) topical hemp products sold pursuant to section 331.

And further moves to amend the bill, in section 10, by striking out, in lines 299 and 300, the words “the seeds thereof;”

And further moves to amend the bill, in said section 10, by striking out, in lines 305 and 306, the words “or the sterilized seed of the plant which is incapable of germination” and inserting in place thereof the following words: ‘, or the seeds of the plant Cannabis sativa L.”

And further moves to amend the bill, in section 17, by striking out, in line 366, the words “the seeds thereof;”

And further moves to amend the bill, in said section 17, by striking out, in line 372, the words “or the sterilized seed of the plant which is incapable of germination” and inserting in place thereof the following words: “, or the seeds of the plant Cannabis sativa L.”

And further moves to amend the bill by striking out section 46 and inserting in place thereof the following section:-

“SECTION 46. Said section 1 of said chapter 94I, as so appearing, is hereby further amended by striking out the definitions “Marijuana”, “Medical marijuana treatment center”, “Medical use marijuana”, “Medical use marijuana license” and “Medical use marijuana licensee”, and inserting in place thereof the following 3 definitions:-

“Marijuana”, as defined in section 1 of chapter 94G.

“Medical marijuana establishment”, a fully integrated medical marijuana treatment center or any other type of licensed medical use of marijuana-related business.

“Medical use marijuana”, marijuana or marijuana accessories sold by a medical marijuana establishment to a card holder for medical use, or marijuana or marijuana accessories possessed by a qualifying patient under a cultivation registration.”
