The committee on Ways and Means, to whom was referred the Bill authorizing the town of Billerica to transfer control of certain land of the town situated in the town of Billerica for recreational purposes for the purposes of constructing the Yankee Doodle Bike Path (House, No. 4440), reports recommending that the same ought to pass with an amendment substituting therefor the accompanying bill (House, No. 5492).

An Act authorizing the town of Billerica to transfer control of certain land in the town of Billerica for the Yankee Doodle Bike Path.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. Notwithstanding any general or special law to the contrary, pursuant to section 5A of chapter 3 of the General Laws the conservation commission of the town of Billerica may transfer to the select board of the town of Billerica, for recreational purposes and subject to Article 97 of the Amendments of the Constitution of the commonwealth, certain land being shown as “E-23”, “FP-9” and “PUE-5” on a plan of land on file with the Massachusetts Department of Transportation and titled “Massachusetts Department of Transportation Highway Division Plan and Profile of Yankee Doodle Bike Path in the Town of Billerica, Middlesex County, Preliminary Right of Way Plans” being a portion of 3 parcels owned by the town of Billerica and described in the town of Billerica assessor’s records as the following: (i) Parcel ID: 78-282-1-1; (ii) Parcel ID: 87-258-1; and (iii) Parcel ID: 87-249-2. The parcels shown as “E-23” and “PUE-5” on said plan of land were acquired by the town in a deed recorded in the Middlesex North registry of deeds at book 3851, page 267 and are currently used for the promotion, development and protection of natural resources. The parcel shown as “FP-9” on said plan of land was acquired by the town in a deed recorded in the Middlesex North registry of deeds at book 2285, page 656 and is currently used for the promotion and development of natural resources and for the protection of watershed resources.
SECTION 2. This act shall take effect upon its passage.
