Nonpublic Ambulance Service Reimbursement Trust Fund Waiver

Mr. Howitt of Seekonk moves to amend the bill by adding the following section:-

"SECTION X. Section 67A of chapter 118E of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by inserting the following subsection:-

(f) The executive office may submit to the federal Centers for Medicare and Medicaid Services, pursuant to 42C.F.R. § 433.68, a request for waiver of the uniformity or broad-based requirements on behalf of any nonpublic ambulance service licensed under 105 CMR 170.000 that demonstrates in any fiscal year that the amount of its liability under this section exceeds the total MassHealth payments it receives, including base rates and supplemental payments.

Such providers shall remain eligible for payments from any trust fund established pursuant to this section, including supplemental payments made under an approved state plan amendment."
