Amendment #3 to H5094

Closing disclosure loopholes on internet advertisements

Mr. LeBoeuf of Worcester moves to amend the bill by adding the following section:

"SECTION XXXX.

(a) Section 18G of chapter 55 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by inserting after the word "association" in lines 2, 5, 12, 14, 17, 18, and 27 the words "or political or party committee".

(b) Section 18G of chapter 55 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by inserting the following as a new third paragraph after the word "voters" in line 47:

"Any expenditure or electioneering communication by a vendor or subvendor on behalf of an individual, corporation, group, association or political or party committee, labor union or other entity shall state in its disclosure statement the individual, corporation, group, association or political or party committee, labor union or other entity that pays for the advertisement and the "Top Contributors" of the payer. For purposes of this section, an entity shall be considered to ‘pay for’ an advertisement if the entity makes a payment, incurs a liability, provides reimbursement, or directs or delegates to another person or entity to make a payment for the purchase, placement, production, or distribution of the advertisement, including payments made through agents, consultants, vendors, or subvendors."

(c) Section 18G of chapter 55 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by inserting in line 23 after the words "internet advertising" the words "and if expenditures on internet advertising exceed an aggregate amount of $250 during a calendar year".

(d) Section 18F of chapter 55 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by striking in lines 2 and 13 the words "not defined as a political committee" and inserting in place thereof, after the word "association" in lines 1, 6, 12, and 26, the words "or political or party committee".

(e) Section 18F of chapter 55 of the General Laws, as appearing in the 2020 Official Edition, is hereby amended by striking in line 10 the word "vendors" and inserting in place thereof the words "vendors and subvendors".".
