Amendment #11 to H5151

Refining Community Centric Permitting for Advanced Nuclear Technologies

Ms. Shand of Newburyport moves to amend the bill inserting the following sections:-

 

SECTION XX. Section 69G of chapter 164 of the General Laws is hereby amended by inserting before the definition of “Anaerobic digestion facility” the following definition:-

 

“Advanced nuclear reactor”, a nuclear fission reactor designed for the purpose of generating electricity with significant improvements compared to reactors operating on December 27, 2020, including improvements such as: (i) additional inherent safety features; (ii) lower waste yields; (iii) improved fuel and material performance; (iv) increased tolerance to loss of fuel cooling; (v) enhanced reliability or improved resilience; (vi) increased proliferation resistance; (vii) increased thermal efficiency; (viii) reduced consumption of cooling water and other environmental impacts; (ix) the ability to integrate into electric applications and nonelectric applications; (x) modular sizes to allow for deployment that corresponds with the demand for electricity or process heat; and (xi) operational flexibility to respond to changes in demand for electricity or process heat and to complement integration with intermittent renewable energy or energy storage.  An advanced nuclear reactor shall not include such a reactor designed primarily for research or demonstration purposes.

 

SECTION XX. Section 69G of chapter 164 of the General Laws is hereby amended by inserting after the definition of “Facility” the following definition:-

 

 “Fusion machine”, a machine that is capable of (1) transforming atomic nuclei, through fusion processes, into different elements, isotopes, or other particles; and (2) directly capturing and using the resultant products, including particles, heat, or other electromagnetic radiation, for the purpose of generating electricity. A fusion machine shall not include such a machine designed primarily for research or demonstration purposes.

 

SECTION XX. Section 69G of chapter 164 of the General Laws is hereby amended by striking out the definition of “Large clean energy generating facility” and inserting in place thereof the following definition:-

 

"Large clean energy generation facility'', energy generation infrastructure with a nameplate capacity of not less than 25 megawatts that is an advanced nuclear reactor, anaerobic digestion facility, fusion machine, solar facility or wind facility, including any ancillary structure that is an integral part of the operation of the large clean energy generation facility, or, following a rulemaking by the board in consultation with the department of energy resources that includes the facility within the regulatory definition of a large clean energy generation facility, any other type of generation facility that does not emit greenhouse gas; provided, however, that the nameplate capacity for solar facilities shall be calculated in direct current, except that advanced nuclear reactors and fusion machines shall be considered a large clean energy generation facility regardless of whether they have a nameplate capacity of less than 25 megawatts.

 

 SECTION XX. Subsection (i) of section 69T of chapter 164 of the General Laws is hereby amended by inserting the following words after the word “but”:-

 

 “, with the exception of advanced nuclear reactors and fusion machines,”
