Amendment #27 to H5151
Reducing Fiscal and Environmental Impacts from Data Centers
Mr. Rogers of Cambridge moves to amend the bill by adding the following section:
“SECTION XXXX. Section 6 of Chapter 64H of the General Laws is hereby amended by striking out, in line 790, “and”, and adding the following subsections after subsection (D) to the definition of “Qualified Data Center”: -
(E) avoids fiscal impacts on electric and water utility ratepayers and municipalities by optimizing water and energy conservation and efficiency, sourcing renewable energy and storage, and connecting to grid support capabilities as determined by the Department of Energy Resources and the Office of Energy and Environmental Affairs;
(F) avoids environmental impacts with a sequential mitigation hierarchy that first avoids impacts, impacts that cannot be avoided are minimized, and impacts that cannot be minimized would be require compensatory mitigation fees for the value of nature’s service and functions as determined by the Department of Energy Resources and the Office of Energy and Environmental Affairs; and”
And in said section by striking out, in line 791, the “(E)” and inserting in place thereof “(G)”.
