Emergency Propane Delivery Authorization

Miss Davis of Great Barrington moves to amend the bill in section 6, in line 80, by inserting after the figure "164.” the following: “Notwithstanding any general or special law to the contrary, a licensed propane supplier may deliver propane to a storage tank not owned by that supplier in the event of an emergency condition. For purposes of this paragraph, “emergency condition” shall include, but not be limited to: (i) interruption of service by the contracted supplier; (ii) insolvency, abandonment, refusal to deliver, or mismanagement by the contracted supplier resulting in failure to provide timely delivery; (iii) a declared local, state or federal emergency; or (iv) circumstances presenting an imminent threat to public health or safety, including risk of loss of heat, hot water or other essential energy services. Prior to making delivery pursuant to this paragraph, the delivering supplier shall: (a) obtain written certification from the consumer that the contracted supplier has failed or is unable to provide timely delivery; and (b) document that the tank complies with applicable safety standards under NFPA 54, NFPA 58 and 248 CMR. A delivery made pursuant to this paragraph shall not be deemed to transfer ownership of the tank, alter existing ownership rights or create a continuing contractual obligation between the delivering supplier and the consumer. The department shall promulgate regulations to implement this paragraph, including documentation and safety requirements necessary to prevent abuse while ensuring continuity of essential propane service.”.
