Amendment #64 to H5151
Farmland and Open Space Protection
Mr. Saunders of Belchertown moves to amend the bill by striking, in line 147, the word “and”.
And further amend the bill, in line 148, by inserting after the words “market stability” the following:
; and (ix) preclude incentive eligibility for energy storage resources sited in whole or in part on: (1) land in agricultural use as defined in section 1 of chapter 61A, except as provided in section 2A of said chapter 61A; (2) land in horticultural use as defined in section 2 of chapter 61A, except as provided in section 2A of said chapter 61A ; (3) important farmland, including all soils found to be important farmland, pursuant to 7 C.F.R. § 657.5; (4) land that is protected under Article 97 of the Amendments to the Constitution; (5) land subject to a conservation, agricultural preservation or watershed preservation restriction as defined in section 31 of chapter 184; (6) a wetland resource area; (7) all districts, sites, buildings, or objects in the state register of historic places established in section 26C of chapter 9 ; or (8) land that is priority habitat or estimated habitat as described in the most recent edition of the Natural Heritage Atlas
