Amendment #3 to H5305
287(g) agreements
Mr. Cabral of New Bedford moves to amend the bill in section 3, in line 207, by inserting after the word “information” the words:
(3) Any employee of the Commonwealth including the department of corrections, jail, houses of corrections, or other correctional institutions of the Commonwealth, sheriffs and their employees, any other law enforcement agencies, municipalities, or other political subdivisions and their employees may only perform functions pursuant to the memorandum of agreement under section 287(g) of the federal Immigration and Nationality Act 8 U.S.C. § 1357, if the costs of such performance, including employee compensation, are borne solely by the federal government as authorized in paragraphs 1 and 2 of this section.
(4) The secretary of the executive office of public safety and security shall keep books, records and accounts of all activities under this section, which shall be open to inspection and shall be annually reported to the house and senate committees on ways and means, the joint committee on the judiciary and the joint committee on public safety and homeland security. Said book shall be a public record, as defined in clause 26 of section 7 of chapter 4 of the General Laws.
