DPH DON Rulemaking

Mr. Diggs of Barnstable moves to amend the bill in section 2, in item 4510-0790, by adding the following: "The Department of Public Health shall engage in rulemaking to address the process for assessing the community health initiative amount with respect to Determination of Need applications involving the reactivation of dormant DoN-Required Equipment. Until such regulation is promulgated, no application for Determination of Need for the reactivation of dormant equipment that was filed before April 17, 2026 and for which the Department of Public Health has not issued a Final Action prior to April 17, 2026 shall be required to comply with a community health initiative assessment calculated based on the expenditure associated with a prior replacement of the dormant equipment as was the case with Beth Israel Deaconess Plymouth’s Determination of Need approved on February 16, 2024."
