Large Employers Utilizing MassHealth Report

Ms. Barber of Somerville moves to amend the bill by adding the following section:-

SECTION X. Section 21 of chapter 12C of the General Laws, is hereby amended by adding the following 3 paragraphs:-

In furtherance of said continuing program of investigation and study, the center shall work in collaboration with other relevant state agencies and departments to annually prepare a public health access program beneficiary employer report. For the purposes of this section, a "public health access program beneficiary" shall mean a person who is an enrollee in a MassHealth program or who is an enrollee in a subsidized health care plan through the Health Connector.

Said public health access program beneficiary employer report shall be produced for each previous state fiscal year and shall provide the following information about each Massachusetts employer of fifty or more public health access beneficiaries: (1) The name and address of the employer; (2) the number of each type of public health access program beneficiaries who are employees of the employer; (3) the number of public health access program beneficiaries who are spouses or dependents of employees of the employer; (4) whether the employer offers any employee health benefits; and (5) the estimated cost to the Commonwealth of providing such public health access program benefits.

The center shall utilize all available data, including self-reported data provided by individuals who apply for public health assistance if applicable, and make methodological decisions as the center determines appropriate to enable the inclusion in said report of a separate analysis aggregating public health access program beneficiaries attributable to any single franchisor licensing ten or more Massachusetts franchises.  The report shall not include the names or other identifying information about any individual public health access program beneficiaries and shall be subject to all relevant federal and state privacy standards.

Said public health access program beneficiary employer report shall be submitted annually on December 1 to the clerk of the house of representatives who shall forward the same to the joint committee on health care financing and to the house and senate committees on ways and means.
