Serious Offenses

Messrs. Moore, Fattman, O'Connor, Tarr and Collins move that the proposed new text be amended in section 3 by inserting at the end of subparagraph (3) the following sentences:-

"An applicant or beneficiary shall be ineligible for the emergency housing assistance program if they have been convicted of a crime, or a pending charge, in Massachusetts on the exclusion list or a substantially similar crime in a jurisdiction other than Massachusetts. The list of serious offenses shall include, but is not limited to: (1) crimes included in the definitions in section 178C of chapter 6 of a sex offense, sex offense involving a child, sexually violent offense, sexually violent predator; (2) any act involving the application of force, intimidation or violence or the threat of force, intimidation or violence by the offender upon the victim, and including any conduct that would constitute a violation of M.G.L. c. 209A or M.G.L. c. 258E; (3) firearm, dangerous weapon, or controlled substances related offenses, but excluding federal and state crimes related to simple possession or consumption of marijuana; and (4) any substantially equivalent crimes to said crimes listed in clauses (1) or (2) that are committed in a jurisdiction other than Massachusetts."
