Amendment #19 to S2581
Social Media and Cell Phone Youth Protection Fund
Mr. Day of Stoneham moves to amend the bill by inserting the following new section:
SECTION 10: Chapter 29 as so appearing is hereby further amended by inserting after section 2DDDDDD the following section:-
Section 2EEEEEE. To enhance the protection of minors, there shall be established and set up on the books of the commonwealth a separate fund to be known as the Social Media and Cell Phone Youth Protection Trust Fund. There shall be credited to the fund all monies collected by the Attorney General of the Commonwealth pursuant to actions undertaken by that office to enforce Chapter 93M and any other reimbursements, appropriations, grants, premiums, gifts, interest or other contributions from any source received that are specifically designated to be credited to the fund. The secretary of the department of elementary and secondary education shall be the trustee of the fund.
To accommodate timing discrepancies between the receipt of revenues and related expenditures, the fund may incur expenses, and the comptroller shall certify for payment amounts not to exceed the most recent revenue estimate certified by the Attorney General and reported in the state accounting system. Amounts credited to the fund shall be subject to further appropriation and monies remaining in the fund at the end of a fiscal year shall not revert to the General Fund and shall be available for expenditure in the subsequent fiscal year.
The secretary shall report annually on or before August 1 to the chairs of the house and senate committees on ways and means and the house and senate chairs of the joint committee on education on the revenue and expenditure activity within the trust fund.
SECTION 11: The secretary shall annually establish a competitive grant program for school districts and municipalities to provide social media literacy educational programs and invest in technology, infrastructure and equipment to facilitate the implementation of Section 40 of Chapter 69 and Section 102 of Chapter 71. The secretary shall distribute monies from the Social Media and Cell Phone Youth Protection Trust Fund to fund this program.
