Loyalty and Rewards Program Data

Mr. Payano, Ms. Miranda and Messrs. Eldridge, Brady, Gómez and Collins move that the proposed new draft be amended by striking out, in lines 374 to 376, the words “provided, however, that the controller shall not transfer personal data to a third party as part of such program unless the transfer of personal data to the third party is clearly disclosed in the terms of the program;” and by inserting in place thereof the following text:- “provided that the selling of personal data is not a condition of participation in the program.”
