Relative to the De-Identification of Data

Mr. Tarr moves that the proposed new draft be amended in line 226 by adding the following clauses after clause (xiii):- “(xiv) information originating from, and intermingled to be indistinguishable with, or information treated in the same manner as (a) Protected Health Information that is maintained by a Covered Entity or Business Associate under HIPAA or (b) Patient Identifying Information maintained by a Program or a Qualified Service Organization under 42 CFR 2 (SAMHSA).

(xv) information included in a Limited Data Set as described at 45 CFR 164.514(e), to the extent that the information is used, disclosed, and maintained in the manner specified at 45 CFR 164.514(e);  and

(xvi) Information used only for Public Health Activities and purposes as described in 45 CFR 164.512(b).”
