Data Privacy Advisory Board

Mr. Tarr moves that the proposed new draft be amended by inserting after section _ the following section:-

"SECTION_. Notwithstanding any general or special law to the contrary within the executive office of technology services and security there shall be a data privacy advisory board. The board shall consist of the secretary of the executive office of technology services and security or their designee whom shall serve as chair; the attorney general or their designee; 3 members representing business organizations appointed by the governor, 1 of whom shall be engaged in the health care sector, 1 of whom shall be engaged in the financial services sector; 3 members of organized labor appointed by the governor;  1 attorney who shall have expertise in data privacy appointed by the governor; 2 members of law enforcement appointed by the governor, 1 of whom shall be a district attorney; and 1 member representing victims of domestic violence appointed by the governor.

The board shall annually review the effectiveness of the provisions of this act, also the economic impacts including but not limited to the burden of compliance and any negative impacts on commerce, and any impact on the development of intellectual property in the commonwealth.

The board shall annually but no later than December 31 submit to the clerks of the house and senate and the attorney general, the board’s findings and any recommendations on changes, or additional action steps, or other measures to increase the strength of data privacy in the commonwealth.
