Temporary Consultation with the AG on Orders

Mr. Moore, Ms. Kennedy and Mr. Payano move that the proposed new draft be amended by inserting after section __ the following section:- 

“SECTION XX. The adjutant general shall consult with the attorney general immediately upon recipient of any order from the federal government purporting to federalize members of the militias of the commonwealth. Said consultation shall include, but is not limited to, a review of the lawfulness of said order, any factual determinations contained within said order, or any facts serving as a predicate for said order. If the attorney general determines that said order is not lawful or that any material fact that serves to support or justify said order is false or inaccurate, the attorney general shall so state in writing to the adjutant general.

SECTION YY. Section XX is hereby repealed.

SECTION ZZ. Section YY shall be effective on January 21, 2025.”
