2nd Redraft Amendment 4

Author's Right to Challenge the Removal of Their Work

Ms. Creem, Messrs. Crighton, Moore and Driscoll, Ms. Jehlen, Ms. Kennedy, Messrs. Payano and Tarr and Ms. Rausch move that the proposed new draft be amended by inserting, in line 18, after the word “guardian” the following:- “, or the author or creator of the materials”;

and further amended by inserting the following section:-

“SECTION X. Said section 33 of said chapter 78, as so appearing, is hereby further amended by inserting at the end thereof the following:-

A decision to remove materials from a free public library in any city or town may be challenged by an individual residing in the city or by the author or creator of the materials, through a petition for a writ of mandamus in the supreme judicial court or superior court.”
