Correcting Deficient Ballot Question Summaries
Mr. Sweezey of Duxbury moves to amend the bill in section 14, in subsection (c), by striking out lines 134 through 136, inclusive, and inserting in place thereof the following:
(ii) the process for ensuring that voters receive a fair and concise summary of an initiative petition, including whether adequate mechanisms exist to identify and correct a summary found to be inaccurate, misleading, unfair, or otherwise constitutionally deficient after it has been published or after signatures have been collected; provided further, that the commission shall include specific recommendations for a proposed amendment to Article XLVIII of the Amendments to the Constitution of the Commonwealth establishing a process by which the attorney general shall prepare a revised fair and concise summary consistent with the findings and reasoning of the supreme judicial court or other court of competent jurisdiction before the measure is printed on the ballot or included in materials distributed to voters;
