Amendment #20 to S3028

Restricting the retail sale of certain birds

Ms. Arriaga of Chicopee moves to amend the bill by adding the following section:

SECTION  XXXX.  section 35WW of chapter 10 of the General Laws by inserting the following section:

No licensed pet shop shall sell or offer for sale any parrot (order Psittaciformes), finch (families Estrildidae or Fringillidae), or canary.

Nothing in this section shall prohibit:

Adoption events conducted by a licensed animal rescue organization or animal shelter, provided the pet shop has no ownership interest in the birds; Adoption fees charged by nonprofit rescue organizations or shelters; The personal gifting or transfer of birds without compensation; or

Educational exhibitions, fairs, or agricultural events where birds are displayed solely for educational or exhibition purposes and are not offered for sale. No person shall sell or offer for sale such birds in parks, roadside locations, outdoor markets, commercial parking lots, or other temporary retail locations. A violation of this section shall be subject to civil penalties of up to $1,000 for a first offense, $2,500 for a second offense, and $5,000 for a third or subsequent offense, and may result in suspension or revocation of a pet shop license. Each unlawful sale or offer for sale shall constitute a separate violation.

This act shall take effect 180 days after its passage.
