Protection of Service and Assistance Animal Rights

Mr. Paulino of Methuen moves to amend the bill in Section 4, in proposed section 5C of chapter 23B, by adding the following subsection: - "(f) Nothing in this section shall limit or otherwise affect the rights or obligations of any person under chapter 151B, the federal Fair Housing Act, section 504 of the federal Rehabilitation Act of 1973 or any other applicable state or federal disability or fair housing law. A service animal or assistance animal required as a reasonable accommodation for a person with disability shall not be subject to a pet deposit, pet fee or other requirement prohibited by applicable state of federal law; provided, however, that a resident may be held responsible for damages caused by such animal to the extent otherwise permitted by law."
