Farm Stand Percentage Waiver

Mr. Tarr moves that the proposed new draft be amended by adding the following section:-SECTION __. Section 3 of chapter 40A of the General Laws as appearing in the 2024 official edition is hereby amended by inserting in line 32 after the word, "viticulture" the following:- "; provided, however, that the commissioner of agricultural resources may, upon written application by a farm, grant a waiver from the percentage requirements set forth in this section if the farm demonstrates that it is unable to meet such requirements due to weather events, market conditions, supply chain disruptions, or other documented hardships. Any waiver issued under this proviso shall certify that the primary use of the property remains agriculture and that the farm stand continues to operate in a manner consistent with the purposes of this section."
