Resilience Buyouts

Messrs. Tarr, Fernandes, Keenan, Collins, Moore and Driscoll and Ms. Jehlen move that the proposed new draft be amended by inserting in SECTION 2C the following new item:-

" 2000-7064 For a program to be established and administered by the secretary of energy and environmental affairs to support a voluntary property buyout program to acquire land that has experienced or is at risk of experiencing repeated coastal and riverine flooding, based on best available data, for the purposes of flood protection and floodplain management, climate change resilience and adaptation, and conserving land for open space, recreation, restoration, and conservation, to be protected pursuant to Article 97 of the Amendments to the Constitution; and provided further the program shall be based on recommendations by the state’s Executive Office of Energy and Environmental Affairs’ ResilientMass Plan, Resilient Coasts Plan, the Massachusetts Emergency Management Agency property buyout and elevation study, and the Office of Coastal Zone Management’s funded studies and assessments; provided further, that grants may be made to state agencies or to cities and towns or not for profit conservation organizations to acquire such lands for the purposes of this item and may as a condition of any grant require the municipality or not for profit conservation organizations to hold title to the acquired land jointly with the commonwealth under the terms of the grant; and provided further, that funds from this item shall not be used to  compensate land owners for lands taken by eminent domain, and provided further that funds from this items shall support tenants’ relocation. Funds shall be deposited in the Global Warming Solutions Trust with collaboration and funding support from all other relevant agencies to support a shared responsibility to a whole-of-government approach....................$75,000,000"
