Streamlining Permitting for Coastal Resiliency Projects in Urban Areas
Mr. Crighton and Ms. Edwards move that the proposed new draft be amended in section 16 after the words “nature based solution projects” in line 1166 by inserting the following new words:- “and public coastal resilience infrastructure projects in previously disturbed and developed areas as defined by EEA.”
And in Section 35, after the words “pedestrian bridge”, by striking lines 1371- 1381 and replacing them with the following new words:-
(ii) public coastal resilience infrastructure projects in previously disturbed and developed areas; (iii) nature based solutions projects and nature based research and demonstration projects; (iv) culvert replacements including, but not limited to, those associated with bridges; (v) great pond drawdowns; (vi) dredging and placement of benthic barriers for invasive vegetation removal and harvesting; (vii) aquaculture not eligible for a permit or license under section 10A; (viii) dredging associated with activities not subject to licensing or permitting; (ix) temporary navigational and access impacts that last less than 1 year and are associated with activities not subject to licensing or permitting; (x) pipelines, cables, conduits, sewers and similar structures installed under flowed tidelands or great ponds that are entirely embedded in the soil and that are installed by horizontal directional drilling or micro tunneling methods; (xi) placement of cultch; and (xii) any other activities and projects that the department determines through regulations to be subject to a general license or general permit.
and by further amending Section 52 after the words “wetlands resilience projects” in line 1989 by inserting the following new words:- “, for public coastal resilience infrastructure in previously disturbed or developed areas”
And in Section 77 by inserting at the end thereof the following words:-
“Further, for previously said sections, the secretary of energy and environmental affairs shall promulgate regulations or issue guidance to identify projects that are public coastal resilience infrastructure in previously disturbed or developed areas.”
