Erosion

Messrs. Cyr and Fernandes move that the proposed new draft be amended by adding the following sections:-

SECTION X. Section 24 of Chapter 82, as appearing in the 2024 Official Edition, is hereby amended by inserting, after the words “seventy-nine, in line 12, the following words:- “; provided, however, that such persons sustaining damages to property by discontinuance of a town way or private way shall only be entitled to property damages caused solely by said discontinuance; provided further, that no persons shall be entitled to property damages under this section for climate related harms, including climate related harms on properties located on discontinued public or town ways”

SECTION X. Section 32A of Chapter 82, as so appearing, is hereby amended by inserting, after the word “travel”, in line 11, the following words:- “or is subject to erosion”

SECTION X. Section 1 of Chapter 84, as so appearing, is hereby amended by inserting, after the word “seasons”, in line 5, the following words:- “; provided, that this section shall not apply to eroding highways and town ways because of climate related harms"
