Upper Cape Water Supply Protection
Messrs. Fernandes and Cyr move that the proposed new draft be amended by inserting after section __ the following sections:-
SECTION __. Chapter 47 of the Acts of 2002 is hereby amended in Section 1 by inserting after the words “the following meanings” the following words:-
“Baseline Impacts”, the level of intensity of the environmental impacts of the training facilities and activities in the Camp Edwards Training Area/Upper Case Water Supply Reserve as they existed during the 2024 training year, as documented in the “State of the Reservation Report Training Year 2024”, and as measured in terms of all of the following: (a) the number of days of use, (b) the number of rounds of ammunition fired, and (c) the number of individuals receiving training.
SECTION __. Chapter 47 of the Acts of 2002 is hereby amended in Section 2, subsection (b) by inserting after the words “wildlife habitat protection” the following words:-
“The construction of any new facility and/or the expansion(s) of any existing facility or activity that would, either alone or in combination, permit an increase of twenty-five percent or greater, beyond the Baseline Impacts, of (a) the number of days of use, (b) the number of rounds of ammunition fired, and/or (c) the number of individuals receiving training is prohibited in the absence of a written finding by the commission, which has been ratified by a two-third vote of the General Court, that the environmental impacts of such construction and/or expansion(s), together with the Baseline Impacts, is compatible with the natural resource purposes of the water supply and wildlife habitat protection.”
