Mr. Rodrigues moves that the proposed new draft be amended in section 2, in item 2840-7028, by adding the following words:- “; provided further, that not less than $1,000,000 shall be expended to the Horseneck Beach State Reservation for capital upgrades, including, but not limited to, purchasing heavy duty equipment, beach nourishment and stone and cobble removal in the town of Westport”; and
in said section 2, in said item 2840-7028 by striking out the figure “$612,375,000” and inserting in place thereof the following figure:- “$623,875,000”; and
in section 2B, in line 140, by striking out the figure “2300-7019” and inserting in place thereof the following figure “2300-7029”; and
in said section 2B, in item 2300-7031, by striking out the figure “$95,000,000” and inserting in place thereof the following figure “$105,500,000”; and
in section 2C, in item 2000-7083, by striking out the figure “$200,000,000” and inserting in place thereof the following figure “$231,750,000”; and
in said section 2C, in item 2000-7089, by adding the following words:- “; provided further, that not less than $1,150,000 shall be expended to the city of Holyoke for a new biosolids dewatering system to assist in wastewater operation; provided further, that not less than $1,000,000 shall be expended to the town of Montgomery for culvert replacement and improvements on Main road; provided further, that not less than $750,000 shall be expended to the city known as the town of Agawam for culvert replacement and improvements on Adams street; provided further, that not less than $750,000 shall be expended to the city of Easthampton for the design and construction of the Lower Mill Pond bridge to protect water boundaries and reduce traffic congestion; provided further, that not less than $550,000 shall be expended to the city of Westfield for culvert replacement and improvements on Bates road; provided further, that not less than $800,000 shall be expended to the city known as the town of West Springfield for the reconstruction of the Prospect Avenue bridge to expand access to the New England National Scenic Trail; provided further, that not less than $1,000,000 shall be expended to the Fall River fire department to support asbestos abatement and environmental remediation at fire stations across the city of Fall River; provided further, that not less than $4,000,000 shall be expended to the water department in the town of Somerset for upgrades and improvements to the town wastewater treatment plant and water pollution control facilities; provided further, that not less than $1,000,000 shall be for necessary capital upgrades for the town dock in the town of Westport including, but not limited to, the harbormaster facility; provided further, that not less than $3,000,000 shall be expended to the town of Swansea for dredging efforts and beach nourishment along the Cole river; and provided further, not less than $5,000,000 shall be expended for environmental remediation in the city of Framingham to support economic development”; and
in said section 2C, in said item 2000-7089, by striking out the figure “$100,000” and inserting in place thereof the following figure: $179,810,000”; and
in said section 2C by striking out the item 2000-7090 in its entirety and inserting in place thereof the following item:-
“2000-7090 For capital grants or other financial assistance related to the planning, technical assistance, design, construction, installation or expansion, or a combination thereof, of clean thermal energy systems and related infrastructure on property under public ownership; provided, that funds may be used for the retrofitting of one or more buildings to support connections to clean thermal energy systems and related infrastructure with the consent of the owner of any such buildings……………$15,000,000”; and
in section 11, by striking out proposed section 10 of chapter 21H; and
in section 14, by striking out, in line 950, the figure “3” and inserting in place thereof the following figure:- 4; and
in said section 14, by striking out, in lines 1150 and 151, the words “March 1, the department shall report on the activities of the fund from the previous calendar” and inserting in place thereof the following words:- “October 1, the department shall report on the activities of the fund from the previous fiscal”; and
in said section 14 by inserting after proposed section 2QQQQQQ of chapter 29 of the General Laws , the following section:-
“Section 2RRRRRR. (a) There shall be established and set up on the books of the commonwealth an expendable trust account known as the Paint Extended Producer Responsibility Trust Fund, which shall be administered by the commissioner of environmental protection. The fund shall be credited with: (i) fees authorized under section 9 of chapter 21H; (ii) any appropriation, grant, gift or other contribution made to the fund; and (iii) any interest earned on money in the fund.
(b) Amounts credited to the trust shall be expended, without further appropriation, for the department of environmental protection to administer the postconsumer paint stewardship program established in section 9 of chapter 21H. The unexpended balance in the trust at the end of a fiscal year shall remain available for expenditure in subsequent fiscal years. No expenditure made from the trust shall cause the fund to be in deficit at any point.”; and
in section 51, by inserting after the word “and” in line 2062, the following word:- “superseding”; and
in said section 51, by inserting after the word “or” in line 2069, the following word:- “superseding”; and
in section 52, by striking out, in lines 1973 and 1974, the words “the protection of fisheries, resilience for changing climate conditions or the protection of the riverfront area consistent with” and inserting in place thereof the following words: “to the protection of fisheries, to resilience for changing climate conditions, or to the protection of the riverfront area consistent with the following purposes:”; and
in said section 52, by striking out, in lines 2011 to 2013, inclusive, the words “the protection of fisheries, resilience for changing climate conditions or the protection of the riverfront area consistent with” and inserting in place thereof the following words:- “the protection of fisheries, resilience for changing climate conditions, or the protection of the riverfront area consistent with the following purposes:” and
by inserting after section 67 the following section:-
SECTION 67A. Item 2000-0103 of section 2A of chapter 102 of the Acts of 2021 is hereby amended by inserting after the word “aqueducts” the following words: “and funding shall be made available until December 31, 2028;”; and
in section 77, by striking out, in line 2376, the figure “18E” and inserting in place thereof the following figure:- “18D”; and
in section 81 by striking out the figure “$3,092,645,000” and inserting in place thereof the following figure:- “$3,370,605,000”; and
in section 83 by striking out the figure “$100,000,000” and inserting in place thereof the following figure:- “$125,000,000”; and
in section 87, by striking out, in line 2569, the words “Section 13” and inserting in place thereof the following words:- “Sections 12 and 13”.
