Wachusett Reservoir Host Community Trust Fund

Mr. O'Day of West Boylston moves to amend the bill by adding the following section:

SECTION XXXX. Chapter 10 of the General Laws is hereby amended by inserting after section 35TTT the following section:-

Section 35UUU. (a) There shall be established a separate special revenue fund to be known as the Wachusett Host Community Trust Fund. The fund shall be administered by the secretary of energy and environmental affairs and shall be used to support the services, public safety and development of municipalities within the Wachusett Reservoir watershed, as defined by the department of conservation and recreation, including, but not limited to, lands authorized to be taken under applicable law for the creation, protection or operation of the Wachusett Reservoir and its watershed.

(b) The fund shall be credited with: (i) revenue from appropriations or other money authorized by the general court and specifically designated to be credited to the fund; (ii) funds from public or private sources, including gifts, grants, donations, rebates and settlements received by the commonwealth that are specifically designated to be credited to the fund; and (iii) interest earned on any money in the fund. Amounts credited to the fund shall be expended without further appropriations and the unexpended balance in the fund at the end of a fiscal year shall remain available for expenditure in subsequent fiscal years. No expenditure made from the fund shall cause the fund to be in deficit at any point.

(c) The secretary, in consultation with the several select boards of the municipalities within the Wachusett Reservoir watershed, shall establish rules and regulations for the administration of the fund.

(d) Annually, not later than October 1, the secretary shall file with the clerks of the senate and house of representatives and the house and senate committees on ways and means a report of the fund’s activities, including but not limited to expenditures made and income received by the fund.
