Melting ICE defenses

Ms. Rausch, Ms. Jehlen and Ms. Howard move that the proposed new text be amended by adding the following sections:-

"SECTION X. Chapter 233 of the General Laws, as appearing in the 2024 Official Edition, is hereby amended by adding the following new section:-

Section 84. Notwithstanding any general or special law to the contrary, a federal agency memorandum shall not constitute a defense to a civil violation of state law, including but not limited to any action in tort and any action pursued under section 11I 5/6 of chapter 12.

SECTION Y. Chapter 265 of the General Laws, as appearing in the 2024 Official Edition, is hereby amended by adding the following new section:-

Section 61. Notwithstanding any general or special law to the contrary, a federal agency memorandum shall not constitute a defense to a violation of state criminal law, including but not limited to violations of this chapter."
