Compliance with Detainers for Felony Offenders

Mr. Fattman moves that the proposed new text be amended by inserting in section 7 the following:-

“(f) Notwithstanding any general or special law to the contrary, upon receipt of a written request from a federal immigration authority requesting detention of an individual who is a convicted felon as defined by chapter 274 of the General Laws, 18 U.S.C. § 3156(a)(3), or 18 U.S.C. § 3559(a), a law enforcement agency may comply with the terms of an immigration detainer request received. For the purposes of this paragraph, the term “law enforcement agency” shall include but not be limited to any state, municipal, college or university police department, sheriff’s department, correctional facility, prosecutorial office, court, probation office, or any other non-federal entity in the commonwealth charged with the enforcement of laws or the custody of detained persons.”
