Psychotropic Medication Oversight and Reporting

Mr. Tarr moves that the proposed new text be amended by inserting after section _ the following section:-

"SECTION_. Chapter 18B of the general laws as so appearing is hereby amended by inserting after SECTION 25 the following new section:-

SECTION 26. (a) The department shall submit quarterly reports to the senate and house committees on ways and means, the joint committee on children, families and persons with disabilities, and the office of the child advocate regarding the prescription and oversight of psychotropic medications for children in the care or custody of the department.

(b) Each quarterly report shall include, but not be limited to:

(1) the number of children prescribed one or more psychotropic medications, delineated by medication class;

(2) the number of Rogers guardianship orders obtained or renewed during the reporting period, including the timeliness of such orders and the number of orders that were overdue or expired;

(3) the number of children whose medical passports were missing, incomplete, or not updated within the prior 6 months;

(4) the number of instances in which documentation of departmental consent for psychotropic medication was missing or incomplete in iFamilyNet;

(5) the number of children prescribed psychotropic medications without documented psychosocial services, including the type of services recommended and whether such services were provided; and

(6) any corrective actions taken by the department to address deficiencies identified in paragraphs (1) through (5).

(c) All data shall be delineated by the child’s age, race, ethnicity, primary language, disability status, placement type, and region.

(d) The department shall publish each quarterly report on its website in accordance with section 19 of chapter 66; provided, however, that any personally identifiable information shall be de‑identified or removed prior to publication."
