Just Employer Transition List
Mr. Mark, Ms. Kennedy and Messrs. Keenan and Feeney move that the proposed new text be amended in section 79 by inserting before the words “section 157(a)” the following words:-
"The department of energy resources shall establish and maintain a Just Employer Transition List of employers, contractors, subcontractors and firms qualified to perform work, including but not limited to work on clean energy, energy efficiency, building decarbonization, solar, energy storage and related infrastructure supported in whole or in part by the commonwealth, in furtherance of the commonwealth’s just transition efforts. To be listed, an employer, contractor, subcontractor or firm shall participate in a registered apprenticeship program approved by the division of apprentice standards or the United States Department of Labor in each apprenticeable trade it performs and utilize registered apprentices consistent with applicable apprentice-to-journeyworker ratios; pay the prescribed rates of wages determined under sections 26 to 27H, inclusive, of chapter 149 on all work to which those sections apply; remain in good standing under the wage, labor, licensing, tax, insurance and workplace safety laws of the commonwealth; and not, within the preceding 5 years, have been debarred or found by a court or agency of competent jurisdiction to have committed willful or repeated violations involving prevailing wage, wage theft, employee misclassification, fraud or worker safety. Any agency, authority, public instrumentality, program administrator, council, commission or committee of the commonwealth may use the list, as warranted, to advance the commonwealth’s just transition, workforce development and responsible procurement objectives, including as a responsible contractor standard, eligibility requirement, scoring preference, expedited review criterion or other requirement in any program, procurement, incentive, financing or initiative it administers. The department may issue guidance or regulations to implement this section."
