Private Right of Action

Ms. Rausch and Messrs. Keenan and Montigny move that the proposed new draft be amended in section 1, in lines 201 through 203, by striking out the words “Notwithstanding sections 9 and 11 of said chapter 93A, the attorney general shall have exclusive authority to bring a civil action against a covered operator that violates this chapter” and inserting in place thereof the following words:-

“The attorney general shall enforce this chapter; provided, however, that nothing herein shall preclude a private right of action asserting violations thereof.”
