Social Feeds
Mr. Tarr moves that the proposed new draft be amended in section 1, by striking lines 8 through 40, inclusive, and inserting in place thereof the following:-
“Addictive social media feed”, a website, online service, online application or mobile application, or a portion thereof, where multiple pieces of content generated or shared by users are recommended, selected, or prioritized for display based primarily on passive behavioral surveillance data. An addictive social media feed shall explicitly not include content recommended, prioritized, or selected based on:
(i) a user's specific and explicit search query;
(ii) a chronological sequence of content exclusively from accounts, creators, or groups the user has affirmatively requested to follow;
(iii) content in a direct or private communication;
(iv) content recommended, prioritized, or selected based on user-selected privacy, safety, or accessibility settings;
(v) content that is exclusively next in a pre-existing sequence from the same author, creator, poster or source; or
(vi) content that the user has expressly and unambiguously requested.”
And further amend said section by inserting, the word “minor” in line 78 the following definition:-
“Passive behavioral surveillance data”, information collected by a covered operator based on a user's unexpressed actions on the platform, including, but not limited to, screen dwell time, scroll rate, interaction frequencies, and predictive behavioral modeling.”
