Licensure Attestation Requirements

Mr. Tarr moves that the proposed new text be amended by inserting in section 16II, subsection (e), paragraph (1), by inserting after subclause (xi) the following new subclause:—  (xii) a requirement for home care agency applicants to submit a sworn attestation, under the pains and penalties of perjury, demonstrating full compliance with federal employment eligibility verification laws, including the completion and maintenance of Employment Eligibility Verification forms (Form I-9), as a condition of obtaining or renewing a license; provided further, that such regulations shall explicitly authorize state investigators to audit a licensee's federal Form I-9 and employment eligibility verification records during regular state monitoring surveys or investigations.
