Prohibiting Dark Patterns in Subscription Cancellation

Mr. Moore moved that the proposed new text be amended in section 28 by inserting before the definition of “Negative option feature” the following definition:-

"'Dark pattern or deceptive design”, a user interface designed or manipulated with the substantial effect of subverting or impairing user autonomy, decision-making or choice, which shall include, but not be limited to, any practice the Federal Trade Commission refers to as a “dark pattern'.”; and by inserting, in line 292, after the word “shall” the following words:- “not use dark patterns or deceptive design and”.
