Delivery of Special Education Study

Messrs. Tarr and O'Connor moved that the proposed new text be amended by inserting after section ____ the following section:-

“SECTION _____. The department of elementary and secondary education, in consultation with at least 1 public institution of higher education, shall study and report on the delivery of special education and services for students with disabilities pursuant to chapter 71B of the General Laws and all applicable federal laws, including, but not limited to, the Individuals with Disabilities Educational Act of 1990 and section 504 of the Rehabilitation Act of 1973. The report shall include: (i) best practices and national standards for the delivery of education and services for students with disabilities; (ii) social and societal factors that impact students diagnosed with a disability pursuant to section 3 of said chapter 71B; and (iii) a comprehensive evaluation of existing and potential models for providing education and services for students with disabilities in-district and out-of-district settings and the associated costs and benefits including, but not limited to, personnel, transportation, housing, specialized services and supports and assistive technologies. The department shall submit a report with recommendations, including any legislative or regulatory changes that may be necessary. The report shall be submitted to the clerks of the house of representatives and the senate, the joint committee on education and the house and senate committees on ways and means not later than May 1, 2027."

Community College and In-State Tuition Program Integrity

Fixing Chapter 70 Inflation

Messrs. Tarr and Durant moved that the proposed new text be amended by inserting after section __ the following sections:-

"SECTION X. Section 2 of chapter 70 of the General Laws is hereby amended by striking the definition of 'Foundation allotments' and inserting in place thereof the following new definition:-

'Foundation allotments', the sum of the foundation category costs for each district; provided, however, that the sum in each foundation category shall be the product of enrollment in each foundation enrollment category that is eligible for the respective foundation category and the per-pupil rate assigned to each foundation category; provided further, that in each year the per-pupil rate for each foundation category, except employee benefits and fixed charges, shall not be less than the foundation per-pupil rate in section 3 of this chapter adjusted by the foundation inflation index; and provided further, that in each year the rate for employee benefits and fixed charges shall not be less than the prior year's rate adjusted by the foundation employee benefits inflation rate.

SECTION XX: Said section 2 of chapter 70 is hereby further amended by striking the definition of 'Foundation inflation index' and inserting in place thereof the following new definition:-

'Foundation inflation index', is the ratio of the value of the implicit price deflator for state and local government consumption expenditures and gross investment in the first quarter of the prior fiscal year to the value of that same deflator in the first quarter of fiscal year two thousand and nineteen; provided that the increase in the index over the prior fiscal year shall not exceed four-and-one-half percent.

SECTION XXX. Section X and section XX of this act shall take effect on September 1, 2026, and shall be used in calculating the foundation budget for school districts beginning in fiscal year two thousand twenty-seven."

and further, in said section 2BBBBBB in the definition of “Remaining income surtax revenue” by inserting after the words “the dedicated higher education income surtax revenue amount” the following words:-

"(a¾) The dedicated K–12 education income surtax revenue amount shall be credited to the Commonwealth K–12 Education Fund established in section 2PPPPPP. Amounts credited to said fund shall be expended, subject to appropriation, for public elementary and secondary education, including but not limited to programs, services, operations, supports, and improvements that advance educational quality, equity, access, and student success in the commonwealth."; and

"SECTION _. Chapter 29 of the General Laws is hereby amended by inserting after section 2OOOOOO the following section:-

Section 2PPPPPP. Commonwealth K–12 Education Fund.

There shall be established and set up on the books of the commonwealth a separate fund to be known as the Commonwealth K–12 Education Fund. The fund shall be credited with: (i) the dedicated K–12 education income surtax revenue amount as defined in section 2BBBBBB; (ii) appropriations or other money authorized or transferred by the general court for the purposes of this fund; (iii) funds from public and private sources, including, but not limited to, gifts, grants and donations; and (iv) any interest earned on the assets of the fund.

Amounts credited to the fund shall be expended, subject to appropriation, for public elementary and secondary education, including but not limited to initiatives, programs, services, operations, supports, increased chapter 70 funding to promote the stability and sustainability of k-12 public school districts, and improvements that further the educational mission of the commonwealth’s public schools.

The unexpended balance in the fund at the end of a fiscal year shall remain available for expenditure in subsequent fiscal years. The fund shall not be subject to section 5C. No expenditure made from the fund shall cause the fund to be in deficit at any point."

Athletic Trainers

SECTION XX. Subsection (b) of section 8A of chapter 69 of the General Laws, as appearing in the 2022 Official Edition, is hereby amended in paragraph (7) by inserting after the word “coaches,” the following word:- athletic.

SECTION XX. Subsection (c) of said section 8A of said chapter 69, as so appearing, is hereby amended by inserting after the word “coaches,” the following word:- athletic.

SECTION XX. Section 54A of chapter 71 of the General Laws, as so appearing, is hereby amended by inserting after the words “eleven C“, in line 3, the following words:- or a licensed athletic trainer, who have completed an annual head injury safety training as required pursuant to 105 CMR 201.007.

SECTION XX. Said section 54A of said chapter 71 is hereby further amended by inserting at the end thereof the following new paragraph:- A licensed athletic trainer shall be employed by a superintendent or school committee at every high school in the commonwealth offering interscholastic athletic activities.

SECTION XX. Section 23A of chapter 112 of the General Laws is hereby amended by striking out in the definition of “Athletic trainer”, as so appearing, the words “and who limits his practice to schools, teams or organizations with whom he is associated”.

SECTION XX. The board of allied health professions shall review and update any applicable rules and regulations in accordance with this act not later than 180 following enactment.

Notwithstanding any general or special law to the contrary, the bureau of purchased services in the operational services division shall determine prices for programs under chapter 71B of the General Laws in fiscal year 2027 by increasing the final fiscal year 2026 price by the rate of inflation as determined by the division. The division shall adjust prices for extraordinary relief pursuant to 808 CMR 1.06(4). The division shall accept applications for program reconstruction and special circumstances in fiscal year 2027. The division shall authorize the fiscal year 2027 price for out-of-state purchasers requested by a program, not to exceed a maximum price determined by the bureau, by identifying the most recent price calculated for the program and applying the estimated rate of inflation for each year, as determined by the bureau under section 22N of chapter 7 of the General Laws, in which the rate of inflation is frozen beginning with fiscal year 2004, in a compounded manner for each fiscal year.”.

Free Community College Program Integrity

Public Institution Adjunct Faculty Advancement Reform

Brady and Velis and Ms. Miranda moved that the proposed new text be amended by inserting at the end thereof the following new section:- “SECTION XX. Chapter 15A of the General Laws, as appearing in the 2024 Official Edition, is hereby amended by inserting after section 15G the following section:-

Section 15H. (a) For the purposes of this section, the following terms shall, unless the context clearly requires otherwise, have the following meanings:

“Adjunct faculty”, faculty employed at 1 or more public institutions of higher education, as defined in section 5 of chapter 15A, on a semester-by-semester basis.

“Impacted adjunct faculty”, adjunct faculty, as defined in this section, who cumulatively work half-time or more at 1 or more public institutions of higher education.

(b) There shall be established and set up on the books of the commonwealth a Full-Time Faculty Pilot Fund, hereafter referred to as the fund, to be administered by the department. The fund shall be credited with: (i) revenue from appropriations or other money authorized by the general court and specifically designated to the fund; (ii) interest earned on such revenues; and (iii) funds from public and private sources, including, but not limited to, gifts, grants and donations. Amounts credited to the fund shall not be subject to further appropriation, and any money remaining in the fund at the end of the fiscal year shall not revert to the General Fund. Amounts received from private sources shall be approved by the department and subject to review before deposit into the fund to ensure that pledged funds are not accompanied by conditions, explicit or implicit, on hiring decisions or academic operations.

(c) Subject to appropriation, the department shall use resources in the fund to administer a Full-Time Faculty Pilot Program. The department shall establish guidelines for the program and distribute resources from the fund by issuing a request for proposal through which public institutions of higher education may apply for funding to create 1 new full-time faculty position. Grants awarded under this section shall be competitive, one-time grants and shall be used solely to support salary and related personnel costs.

The department shall award grants based on demonstrated institutional capacity, need, readiness to support the faculty position and ability to financially sustain the full-time position after the grant funds are exhausted. In evaluating proposals, the department shall consider regional equity to ensure equitable distribution of funds across the commonwealth. The department shall fund at least 1 campus in each of the following: (i) the University of Massachusetts segment; (ii) the state university segment; and (iii) the community college segment.

(d) Not later than 6 months after the completion of the hiring process for a position funded under this section, each grant recipient shall submit a report to the department including, but not limited to, the following:

(i) benefits and challenges experienced in creating the new full-time faculty position;

(ii) how the campus or institution advertised the position internally and externally;

(iii) whether the campus or institution hired an adjunct faculty member or impacted adjunct faculty member already employed at the same campus or institution and an explanation of its decision;

(iv) an explanation of the impact of the hired adjunct faculty at the same institution, including, but not limited to, whether positions for impacted adjunct faculty were reduced or eliminated;

(v) an explanation of the institution or campus’ approach to funding fringe benefits for all eligible employees and for the new full-time employee and any associated challenges; and

(vi) any recommendations for improving the process for hiring full-time faculty at public institutions of higher education and for achieving a balanced utilization of adjunct faculty at the recipient’s campus.

(e) Not later than 1 year following the release of the grant funds, the department shall submit a report analyzing the results of the Full-Time Faculty Pilot Program to the clerks of the house of representatives and senate, the house and senate committees on ways and means and the joint committee on higher education. The report shall include, but not be limited to:

(i) the information submitted by grant recipients pursuant to subsection (d);

(ii) the department’s analysis of the compiled reports and any associated trends, patterns or anomalies;

(iii) recommendations for improving upon the process and feasibility of hiring full-time faculty at public institutions of higher education, delineated by segment;

(iv) recommendations for quantifying and achieving a balanced utilization of adjunct faculty at public institutions of higher education, including, but not limited to, recommendations addressing the role of fringe benefits on the ability and interest of campuses to hire full-time faculty members; and

(v) the text of any proposed legislation necessary to carry out its recommendations.

SECTION XX (a) For the purposes of this section, the following terms shall, unless the context clearly requires otherwise, have the following meanings:

“Adjunct faculty”, faculty employed at 1 or more public institutions of higher education, as defined in section 5 of chapter 15A of the General Laws, on a semester-by-semester basis.

“Impacted adjunct faculty”, adjunct faculty, as defined in this section, who cumulatively work half-time or more at 1 or more public institutions of higher education.

(a) Notwithstanding any general or special law to the contrary, a special commission is hereby established to develop a system and implementation plan that enables impacted adjunct faculty members to be eligible for and receive benefits including, but not limited to, health insurance and retirement benefits that are otherwise available to other benefited public employees.

(b) The special commission shall include, but not be limited to: the secretary of administration and finance or a designee, who shall serve as co-chair; the chair of the board of higher education or a designee, who shall serve as co-chair; the commissioner of higher education or a designee; the comptroller or a designee; the executive director of the public employee retirement administration commission or a designee; the executive director of the group insurance commission or a designee; the chairs of the joint committee on higher education; a representative from the University of Massachusetts segment, appointed by the president of the University of Massachusetts; a representative from the state university segment, appointed by the State University Council of Presidents; a representative of the community college segment, appointed by the Massachusetts Association of Community Colleges; a representative from the Massachusetts Teachers Association; a representative from the Massachusetts State College Association; a representative from the Massachusetts Community College Council; 3 members appointed by the commissioner of higher education who shall represent adjunct faculty from each of the 3 segments of the Massachusetts public higher education system; and a member of the student advisory committee to the board of higher education, appointed by the student advisory committee. The executive office of administration and finance and the department of higher education shall furnish reasonable staff and other support for the work of the special commission.

(i) current data, practices and strategies on adjunct faculty utilization across the public higher education system in the commonwealth, including the number and use cases of adjunct faculty and professional staff and impacted adjunct faculty employed by institution and by segment, as compared to the number of full-time faculty;

(ii) the compensation and benefits currently available to adjunct faculty members and professional staff across the public higher education system in the commonwealth, including how such costs are borne between institutional resources and state appropriations;

(iii) nationwide best practices in the employment and compensation of adjunct faculty; and

(iv) other relevant aspects including the impacts on campuses, students and student outcomes of adjunct faculty utilization.

(d) The special commission shall issue recommendations and an implementation plan for providing state benefits to impacted adjunct faculty including, but not limited to:

(i) steps necessary to develop a system that allows any impacted adjunct faculty, including those who work in a division of continuing education, regardless of funding source, including but not limited to subsidiary account CC, to be considered an employee eligible for membership in the state employees’ retirement system and able to earn creditable service for such time, or in the optional retirement program;

(ii) steps necessary to develop a system that allows any impacted adjunct faculty, including those who work in a division of continuing education, regardless of funding source, including but not limited to subsidiary account CC, to be considered an employee eligible for employee benefits outlined in chapter 32A of the General Laws which are made available to other benefitted half or full-time employees at the same institution;

(iii) estimates of annual costs for implementation of clauses (i) and (ii) and proposals for how the commonwealth could fund said costs;

(iv) solutions to barriers that currently prevent or limit public institutions of higher education from increasing the number of full-time faculty positions, including, but not limited to, an analysis of the funding mechanisms currently in place related to hiring additional full-time faculty and recommendations for potential incentives to encourage the hiring of full-time faculty; and

(v) additional recommendations for improving access to public benefits, professional development opportunities and other institutional resources for adjunct faculty.

(d) Not later than 6 months following the enactment of this act, the working group shall submit its report and recommendations, including the text of any proposed legislation and costs necessary to carry out its recommendations, to the governor, the clerks of the house of representatives and the senate, the chairs of the house and senate committees on ways and means and the chairs of the joint committee on higher education.

SECTION XX Not later than 90 days following enactment of this act, the department of higher education shall promulgate rules and regulations for the Full-Time Faculty Pilot Program established in section 15H of chapter 15A of the General Laws.

SECTION XX Members shall be appointed to the special commission established in section 2 of this act not later than 30 days following enactment of this act.”.

Electronic Backpack for Foster Children

Section 100. (a) As used in this section, the following terms shall, unless the context requires otherwise, have the following meanings:-

“Department”, shall mean the department of elementary and secondary education.

“Foster child or youth”, shall mean a child under the care or custody of the department of children and families or a young adult who has signed a voluntary placement agreement with the department of children and families.

“Electronic backpack”, shall mean an electronic repository of a foster child or youth’s educational records.

(b) Notwithstanding any general or special law to the contrary, the commissioner of the department, in consultation with the office of the child advocate and the commissioner of the department of children and families, shall develop and implement an electronic backpack system for the educational stability of foster child or youth.

(c) The department shall create an electronic backpack for each foster child or youth. The department, in conjunction with the department of children and families, shall promulgate regulations on the format and function of the electronic backpack system. Each electronic backpack system shall contain, but is not limited to, the educational records of the foster child or youth, including the names and addresses of educational providers, the name and contact of the child’s DCF case worker if applicable, the foster child or youth’s grade-level performance, transcript, the foster child or youth’s school attendance records, individual education plan if applicable, the name and contact information of the individual or individuals who are designated as the child’s educational decision makers, the name of the legal guardian with signing rights to release the child from school, visit notes from the school nurse, guidance counselor, or other administrators, detailed notes on best interest determination meetings, if applicable, and any other educational information that the department requires. The department shall maintain the electronic backpack as part of the department’s records for the foster child or youth as long as the foster child or youth remains in foster care.

(d) The department shall make the electronic backpack available to:

(i) Any person authorized by law to make educational decisions for the foster child or youth;

(ii) The teacher/teachers, school and school district that the child or youth is enrolled in;

(iii) Any person authorized to consent to medical care for the foster child or youth; and

(iv) Any provider of medical care to the foster child or youth if access to the foster child or youth’s educational information is necessary for the provision of medical care and is not prohibited by law.

(e) The department shall collaborate with the department of children and families to develop policies and procedures to ensure that the needs of foster child or youths are met in every school district.

SECTION X. The department shall implement the electronic backpack program within one year of the passage of this act.”

Section 30. As used in this section, the following words shall have the following meanings unless the context clearly requires otherwise:

'Newborn child', a child not more than 6 months of age.

'Student loan', a loan primarily used to finance education or other school-related expenses.

'Borrower', a resident of the commonwealth who has received or agreed to pay a student loan or a person who shares responsibility with that resident for repaying the student loan.

The Massachusetts Educational Finance Authority, in consultation with the Office of the Attorney General, shall promulgate regulations and develop a program to allow for the deferment of student loans dispersed by the Authority by any borrower who is pregnant or who is a parent or guardian caring for or adopting a newborn child. Said regulation shall: (i) include a deferment period of not less than 6 months; (ii) require a birth certificate, adoption certificate, or appropriate documentation from a healthcare professional or primary care doctor; and (iii) be established no later than December 31, 2027.”

Improving Air Quality in Schools

"SECTION X. (a) There shall be an interagency task force to review and investigate indoor air quality in public school buildings that provide education for children in kindergarten through grade 12.

(b) The task force shall consist of the following 17 members or their designees: the commissioner of elementary and secondary education, who shall serve as co-chair; the commissioner of public health, who shall serve as co-chair; the executive director of the Massachusetts school building authority; the director of the department of labor standards; the commissioner of the department of environmental protection; the state fire marshal; 1 member appointed by the speaker of the house of representatives; 1 member appointed by the minority leader of the house of representatives; 1 member appointed by the senate president; 1 member appointed by the minority leader of the senate; 1 member appointed by the governor who is an expert in the field of environmental health and indoor air quality; and 1 member to be appointed by each of the following organizations: the Massachusetts Association of School Committees, Inc., the Massachusetts Association of School Superintendents, Inc., the Massachusetts Teachers Association, the American Federation of Teachers Massachusetts the Massachusetts Coalition for Occupational Safety and Health, and the Massachusetts School Nurses Organization.

(c) The task force shall investigate indicators of indoor air quality in public school buildings and ways to ensure adequate indoor air quality in such school buildings, including but not limited to: (i) an assessment of carbon monoxide detection systems within each public school building and each school’s compliance with subsection (a½) of section 26F½ of chapter 148 of the General Laws; (ii) best practices for the placement and installation of carbon monoxide detection systems in public school buildings; (iii) the status of carbon dioxide levels in public school buildings according to data collected from existing carbon dioxide monitoring systems in public school buildings; (iv) the necessity and feasibility of installing carbon dioxide monitoring systems in all public school buildings and collecting data from such systems; (v) the temporary or ongoing use of equipment necessary to ensure adequate air filtration and ventilation within public school buildings; (vi) the regulation of minimum and maximum allowable air temperatures and relative humidity, as well as any relevant statistics on the number of air-conditioned public schools; (vii) an evaluation of the grants distributed pursuant to 1599-2055 of section 2A of chapter 102 of the acts of 2021; and (viii) the cost, including labor costs, of implementing any recommendations.

(d) Not later than October 1, 2027, the task force shall file a report on its findings, including any analysis, recommendations, or proposed legislation, with the clerks of the senate and house of representatives and the chairs of the joint committee on education.”

(a) As used in this section, the following words shall, unless the context clearly requires otherwise, have the following meanings:

(i) “Community School”, a public school that utilizes a community school coordinator to facilitate the establishment of a set of strategic partnerships between the school and other community resources that leverage shared accountability, collaborative leadership, capacity building, and family and community engagement, to promote student achievement, and the well-being of students, families, educators, and neighborhood residents through a variety of engaging practices including the provision of wraparound services.

(ii) “Community Schools strategy”, a strategy that transforms a school into a community school where educators, local community members, families, and students work together to establish shared vision and goals to strengthen conditions for student learning and healthy development, including but not limited to the organization of in- and out-of-school resources, supports, and student opportunities.

(b) There shall be a special legislative commission on community schools, hereinafter referred to as the commission, to investigate community schools and to make recommendations regarding the adoption of community schools across the commonwealth. The special legislative commission shall consist of 15 members: the house and senate chairs of the joint committee on education, or their designee, who shall serve as co-chairs; the secretary of Education or a designee; the secretary of Health and Human services or a designee; 1 representative from the Massachusetts Community Schools Coalition; 1 representative from the American Federation of Teachers Massachusetts; 1 representative from Massachusetts Teachers Association; 1 representative from United Way of Massachusetts Bay; and 7 members to be appointed by the Governor: 2 of whom shall be student representatives from existing Massachusetts community schools, 1 of whom shall be a parent representative from an existing Massachusetts community schools, 1 of whom shall be a superintendent from a Massachusetts district employing community school strategies, 1 of whom shall be a principal of a Massachusetts community school, 1 of whom shall be a Massachusetts community school coordinator, and 1 of whom shall be a member who represents a community based organization. In making such appointments, the Governor shall consider rural, urban, and suburban geographic representation across the commission.

(c) The commission shall: (i) analyze systems, structures, and policies that support successful community school implementation models and trends in community school model adoption across different jurisdictions in the Commonwealth and nationwide; (ii) investigate the policies of other such jurisdictions intended to support and incentivize community school model adoption, (iii) provide an assessment of community school adoption, implementation, and outcomes in Massachusetts; (iv) define the essential elements and principles of implementing community school models, including but not limited to as an equity strategy; (v) research the outcomes and evidence associated with community schools model adoption, including but not limited to reductions in school absenteeism; (vi) investigate the policies of other jurisdictions intended to support and incentivize community school adoption; (vii) identify any existing barriers, including but not limited to legal, regulatory, information and training, or funding barriers for Massachusetts schools to successfully adopt and implement community school strategies. The commission shall meet not less than once every two months.

(d) The commission shall develop a report of its findings and include specific recommendations in response to such findings, including any legislative or regulatory changes necessary for the Commonwealth to implement the commission’s recommendations. At a minimum, such report shall include: (i) an overview of the findings of the commission’s work pursuant to subsection (b), including but not limited to policy recommendations relative to codifying definitions relative to community schools; adopting policies and funding strategies to incentivize statewide adoption of community school strategies; and, creating sustainable funding streams in support of local district and school-level adoption and implementation of community school strategies; (ii) recommendations for a statewide community school pilot program including, but not limited to: (1) the number and nature of eligible communities to participate in the pilot program, (2) the resources necessary to support the pilot program, (3) the process by which pilot funding should be awarded, and (4) the data and outcomes reporting requirements and criteria for the evaluation of the pilot program and its participants. The commission shall file its report with the clerks of the senate and the house of representatives, the senate and house committees on ways and means, the joint committee on education, the office of the governor, and the executive office of education not later than February 15, 2027.”.

(b) The commission shall consist of: the commissioner of elementary and secondary education, or a designee, who shall serve as chair; the commissioner of higher education, or a designee; the secretary of education, or a designee; the house and senate chairs of the joint committee on education, or their designees; 1 member appointed by the speaker of the house; 1 member appointed by the president of the senate; 1 member appointed by the minority leader of the house; 1 member appointed by the minority leader of the senate; 1 representative of the Massachusetts Teachers Association; 1 representative of the American Federation of Teachers Massachusetts; 1 representative of the Massachusetts Association of School Superintendents; 1 representative of the Massachusetts Association of School Committees; 1 representative from Massachusetts Business Alliance for Education; 1 representative from the Massachusetts Municipal Association; 1 parent of a student enrolled in a Massachusetts public school appointed by the governor; and 3 members with expertise in literacy, student assessment or education workforce development appointed by the governor.

(i) student learning outcomes in English language arts and mathematics, including whether students are reading and performing at or above grade level by grade 3, grade 8 and grade 10;

(ii) the extent and persistence of learning loss attributable to the COVID 19 pandemic and the effectiveness of district recovery strategies;

(iii) achievement gaps by race, ethnicity, income, disability status, English learner status and geography;

(iv) teacher qualifications, including licensure, preparation pathways, in field teaching assignments and years of experience;

(v) educator workforce conditions, including vacancies, turnover, retention, recruitment challenges and pipeline programs;

(vi) the use of state, local and federal funds—including federal COVID 19 relief funds and Student Opportunity Act funds—to determine whether expenditures have been directed toward evidence based practices that improve student learning;

(vii) whether additional funding alone is sufficient to improve student outcomes or whether structural, regulatory or programmatic changes are necessary to ensure that resources are used effectively;

(viii) options to improve student learning and expand educational opportunity, including but not limited models that increase access to high quality educational options for students and families; and

(ix) a comparison of the commonwealth’s post COVID education strategies with those of other states, including but not limited to literacy reforms, learning loss recovery initiatives, educator workforce strategies and models that expand educational opportunity.

(d) The commission shall identify best practices, high impact interventions and barriers to implementation, and shall make recommendations for legislative or regulatory changes, including changes to accountability, data reporting, educator preparation, licensure or funding structures, as the commission deems appropriate.

(e) The commission shall hold at least 3 public hearings in geographically diverse locations in the commonwealth, shall consult with educators, parents, students, researchers and community organizations, and shall use existing data collections to the maximum extent practicable.

(f) Not later than March 1, 2027, the commission shall file a report of its findings and recommendations, including any proposed legislation, with the clerks of the senate and house of representatives, the joint committee on education and the house and senate committees on ways and means. The report shall be made publicly available on the department of elementary and secondary education’s website.

Operational grants to childcare providers

C3 Operational Grants Formula Fix to ensure equity

"SECTION_. Section 20 of chapter 15D of the General Laws is hereby amended by inserting after subsection (c) the following subsection:-

(c¾) In developing and maintaining the formula for distributing operational grants under this section, the department shall ensure that equity-related adjustments are based on the socioeconomic characteristics of the municipality in which the early education and care provider is physically located and the aggregate demographics of the children enrolled at the provider. Equity adjustments shall not be allocated on the basis of regional or proximity-based indicators that reflect the socioeconomic characteristics of neighboring municipalities or census tracts when such indicators do not accurately represent the socioeconomic characteristics of the provider’s own municipality or enrolled population.

To ensure that equity-related adjustments are directed to providers serving families with the greatest needs, the department shall establish minimum thresholds of enrollment of high-need children for providers to qualify for equity-related adjustments. Such thresholds shall be based on the proportion of enrolled children who: (i) receive childcare financial assistance; (ii) are identified as high needs; or (iii) reside in communities with documented socioeconomic disadvantage. No provider located in a higher-income municipality shall qualify for equity-related adjustments unless the provider enrolls a meaningful percentage of high-need children, as determined by the department and documented in writing.

The department shall incorporate municipality-specific socioeconomic indicators, including but not limited to median household income, child poverty rates and documented shortages of early education and care slots, into the formula. The department shall include in the annual report required under subsection (g) a description of how proximity-based indicators were excluded or adjusted under this subsection, the thresholds established for high-need enrollment, and an analysis of the impact of these changes on geographic and socioeconomic equity."

(a) There shall be a special commission to study vocational-technical education program admissions in the commonwealth and to make recommendations on: (i) admissions policies pursuant to chapter 74 of the General Laws; (ii) the collection, dissemination, and analysis of district-level and statewide data on vocational-technical education program admissions and waitlists pursuant to said chapter 74; and (iii) the enforcement and review standards for said admissions policies and related data.

(b) The commission shall consist of the following 9 members: 3 members of the senate, including the senate chair of the joint committee on education who shall serve as co-chair, 1 member appointed by the senate minority leader, and 1 member appointed by the senate president; 3 members of the house of representatives, including the house chair of the joint committee on education who shall serve as co-chair, 1 member appointed by the house minority leader, and 1 member appointed by the speaker of the house of representatives; 1 representative of the Massachusetts Association of Vocational Administrators; 1 superintendent or principal from a vocational-technical school; and 1 graduate of a vocational-technical high school or an employer in the trades industry.

(c) The first meeting of the commission shall be held not later than September 15, 2026. The commission shall conduct at least 1 public hearing to solicit testimony from the public. Not later than September 15, 2027, the commission shall file a report with its findings and recommendations, including any proposed legislation, with the clerks of the house and senate and the house and senate committees on ways and means."

Mr. Brady moved that the proposed new text be amended in section 2, in item 7010-1192, by adding the following words:- "; provided further, that not less than $16,566.38 shall be expended to the Halifax Elementary School for the replacement of the telephone system’’; and by striking out the figure $180,000,000” and inserting in place thereof the following figure:- “$180,016,566.38”.

Halifax Elementary School Telephone Upgrade

Mr. Brady moved that the proposed new text be amended in section 2, in item 7010-1192, by adding the following words:- "; provided further, that not less than $16,566 shall be expended to the Halifax elementary school for the replacement of the telephone system; provided further, that not less than $50,000 shall be expended to the Choices4Teens Mentoring Group Inc. for a mentoring program to improve outcomes for at-risk youth, to address social and behavioral issues and to support violence prevention in the city of Brockton”; and by striking out the figure “$100,000” and inserting in place thereof the following figure:- “$166,566”.

Vocational School Sibling Admission Reform

Messrs. Fattman and O'Connor moved that the proposed new text be amended by inserting after section X the following section:-

"SECTION X. Notwithstanding any general or special law to the contrary, a vocational technical school district, regional vocational technical school district, or agricultural school may revise and implement admissions policies for career technical education programs considering the status of sibling admission within the lottery-based admissions system. This admission policy may be adopted by the school committee or governing board of the district and shall be set forth in writing.

The department of elementary and secondary education promulgate or revise regulations, including but not limited to 603 CMR 4.00, as necessary to implement this section.

This section shall take effect 90 days after the passage of this act.”
