Federal Scholarship Tax Credit Program

Mr. Fattman moved that the proposed new text be amended by inserting after section X the following section:-

“SECTION X. Chapter 62C of the General Laws is hereby amended by inserting after section 89 the following section:

Section 89A. (a) The commonwealth shall participate in the federal scholarship tax credit established under section 70411 of Pub. Law No. 119-21.

(b) The commissioner of revenue shall:

(1)  by the first day of January of each year, annually submit to the Secretary of the Treasury of the United States and publish on the website of the department of revenue a list of all qualified scholarship granting organizations that meet the requirements under section 70411 of Pub. Law No. 119-21 and are located in the commonwealth;

(2) certify the commissioner’s authority to submit such list upon submission;

(3) comply with any other requirements under section 70411 of Pub. Law No. 119-21, including any applicable federal regulations or guidance, to ensure that the commonwealth is eligible to participate in taxable years beginning after December 31, 2026; and

(4) accept applications from scholarship granting organizations throughout the year for inclusion on the list submitted pursuant to paragraph (1).

(c) The department of revenue, in conjunction with department of elementary and secondary education, may adopt or promulgate rules to implement this section in accordance with applicable federal law, regulations, or guidance.

SECTION X. This act shall take effect upon its passage.”
