"'Dark pattern or deceptive design”, a user interface designed or manipulated with the substantial effect of subverting or impairing user autonomy, decision-making or choice, which shall include, but not be limited to, any practice the Federal Trade Commission refers to as a “dark pattern'.”; and by inserting, in line 292, after the word “shall” the following words:- “not use dark patterns or deceptive design and”.

Relative to the Impacts of MBTA Zoning

1. the number of housing units produced pursuant to Chapter 40A, S.3A of the general laws

2. the impacts on municipal water supplies, wastewater treatment, and transportation infrastructure of such units, and,

3. the impacts of the production of such units on the local school districts where such units are located.

and provided further, that the results of said study, analysis, and determinations shall be filed as a report with the clerks of the House and Senate, and the Joint Committee on Housing not later than December 31."

Mitigating Cost Increases of Unemployment Insurance

Mr. Tarr, Mrs. Dooner and Mr. O'Connor moved that the proposed new text be amended by inserting after section ___ the following section:-

"SECTION__ -  There shall be a special commission to conduct an analysis of the impacts on employers in the commonwealth of unemployment insurance cost increases attributable to the disallowed use of federal COVID-19 relief funds for unemployment claims, and the resulting settlement agreement between the commonwealth and the federal government, and develop recommendations for mitigating, to the maximum feasible extent, cost increases caused by these factors. The commission shall consist of 13 members, including the Secretary of Labor And Workforce Development, or a designee, whom shall act as its chair, and 12 members appointed by the governor, one of which shall represent the National Federation of Independent Business, one of which shall represent the Retailers Association of Massachusetts, one of whom shall represent the Associated Industries of Massachusetts, two of whom shall represent organized labor in the commonwealth, two of whom shall represent employees not affiliated with organized labor in the commonwealth, two of which shall be affiliated with the University of Massachusetts, one of which shall have experience in labor law, and one of which shall have experience in economics, and one member representing the Massachusetts Taxpayers Foundation. In carrying out the provisions of this section, the commission shall meet not less than 3 times, and conduct not less than 3 public hearings in geographically diverse regions of the commonwealth, provided that at least one of which shall allow remote electronic participation. The commission shall file a report of its findings, together with any legislative, regulatory and other recommendations, with the clerks of the House and Senate, the Senate and House Committees on Ways and Means, the Joint Committee on Economic Development and Emerging Technologies, and the Secretary of Administration and Finance not later than December 31, 2027."

The procurement officer shall make a record of each emergency as soon after the procurement as practicable, specifying each contractor's name, the amount and the type of each contract, a listing of the supply or service provided under each contract, and the basis for determining the need for an emergency procurement, provided that such record shall include written findings specifying the cause and circumstances of the emergency, the reasons why it was not reasonably foreseeable, and any identifiable risks arising from not utilizing an emergency contract. The procurement officer shall submit a copy of this record at the earliest possible time to the state secretary for placement in any publication established by the state secretary for the advertisement of procurements and shall also submit a copy of such record to the inspector general, for review provided further, that the inspector general shall file a report containing the results of such review in a timely manner with the clerks of the house and senate.”

 “SECTION _. Chapter 62 of the General Laws is hereby amended by inserting after section 5D the following 2 sections:-

 Section 5E. (a) For the purposes of this section, the following words shall have the following meanings unless the context clearly requires otherwise:-

 “Account holder”, an individual who establishes, individually or jointly with one or more other individuals, a rental savings account.

 “Allowable costs”, a fee paid for renting a unit as a permanent residence in the commonwealth, limited to the amount of: (i) first and last month's rent; (ii) a security deposit equal to one month's rent; and (iii) the purchase and installation costs of a lock and key. “Eligible costs”, fees paid for renting a unit as a permanent residence in the commonwealth, limited to the amount of: (i) first and last month's rent; (ii) a security deposit equal to one month's rent; and (iii) the purchase and installation costs of a lock and key.

 “Financial institution”, any bank, trust company, savings institution, industrial loan association, consumer finance company, credit union, benefit association, insurance company, safe deposit company, money market mutual fund or similar entity authorized to do business in the commonwealth.

 “Qualified beneficiary”, an individual seeking to rent a unit as a permanent residence.

 (b) Beginning January 1, 2026, an individual may open an account with a financial institution and designate the account as a rental savings account to pay or reimburse a qualified beneficiary’s eligible costs.

 (c) An account holder must designate, not later than April 15 of the year following the tax year during which the account is established, a resident as the qualified beneficiary of the rental savings account. The account holder may designate themselves as the qualified beneficiary and may change the designated qualified beneficiary at any time; provided, however, there shall not be more than 1 qualified beneficiary at any time.

 (d) An individual may jointly own a rental savings account with another person if the joint account holders file a joint income tax return; provided, however, this requirement shall not apply if at least 1 person would not otherwise be required to make a return because their Massachusetts gross income did not exceed $8,000.

 (e) An individual may be the account holder of more than 1 rental savings account; provided, however, that the account holder shall not have multiple accounts that designate the same qualified beneficiary.

 (f) An individual may be designated as the qualified beneficiary on more than 1 rental savings account.

 (g) Only cash and marketable securities shall comprise a rental savings account. Subject to the limitations of this section, persons other than the account holder may contribute funds to a rental savings account. There shall be no limitation on the amount of contributions that may be made to or retained in a rental savings account.

 (h) The funds held in a rental savings account shall not be used to pay expenses of administering the account; provided, however, that a service fee may be deducted from the account by the financial institution.

 (i) The account holder shall submit to the department of revenue: (1) detailed information regarding the rental savings account, including a list of transactions for the account during the tax year and the Form 1099 under the Internal Revenue Service requirements issued by the financial institution for such account with the account holder’s Massachusetts income tax return on forms prepared by the department of revenue; and (2) a detailed accounting of the eligible costs toward which the account funds were applied, if there was a withdrawal from the account, and a statement of the amount of funds remaining in the account.

 (j) A financial institution shall not be required to: (1) designate an account as a rental savings account, or designate the qualified beneficiaries of an account, in the financial institution’s account contracts or systems; (2) track the use of funds withdrawn from a rental savings account; (3) allocate funds in a rental savings account among joint account holders or multiple qualified beneficiaries; or (4) report any information to the department of revenue or other government agency that is not otherwise required by law.

 (k) A financial institution shall not be liable for: (1) determining or ensuring that an account satisfies the requirements to be a rental savings account; (2) determining or ensuring that funds in a rental savings account are used for eligible costs; or (3) reporting or remitting taxes or penalties related to the use of a rental savings account.

 (l) Except as otherwise provided in this section and subject to the limitations under this subsection, there shall be deducted from taxable income of an account holder, for Massachusetts income tax purposes: (1) the amount contributed to a rental savings account during each tax year, not to exceed $15,000 for an account holder who files an individual tax return or $30,000 for joint account holders; (2) the amount of earnings, including interest and other income on the principal, from the rental savings account during the tax year.

 (m) An account holder may claim the deduction and exclusion under subsection (k): (1) for a period not to exceed 15 years; (2) for an aggregate total amount of principal and earnings not to exceed $50,000 during said 15-year period; and (3) only if the principal and earnings of the account remain in the account until a withdrawal is made for eligible costs related to the securing a rental intended as a permanent residence.

 (n) Any funds in a rental savings account not expended on eligible costs by December 31 of the last year of the 15-year period under shall thereafter be included in the account holder’s taxable income.

 (o) A person other than the account holder who deposits funds in a rental savings account shall not be entitled to the deduction and exclusion provided for under this section.

 (p) The deduction and exclusion from taxable income provided for by this section shall apply to any alternative bases for calculating taxable income for Massachusetts income tax purposes.

 (q) Except as otherwise authorized in this section, if the account holder withdraws any funds from a rental savings account for a purpose other than eligible costs for the securing a rental property to be used as a permanent residence: (1) such funds shall be included in the account holder’s taxable income; and (2) the account holder shall pay a penalty to the department of revenue equal to the tax that would have been collected had the withdrawn funds been subject to income tax. Such penalty shall not apply to funds withdrawn from an account that were: (i) withdrawn by reason of the account holder’s death or disability; (ii) a disbursement of assets of the account pursuant to a filing for protection under the United States Bankruptcy Code, 11 U.S.C. § 101 et seq.; or (iii) a transfer of the funds from a rental savings account to a new rental savings account held by a different financial institution or the same financial institution.

 (r) The department of revenue shall prepare forms for: (1) the designation of an account with a financial institution to serve as a first-time home buyer savings account; (2) the designation of a qualified beneficiary of a rental savings account; and (3) an account holder to annually submit to the department of revenue detailed information regarding the rental savings account, including but not limited to a list of transactions for the account during the tax year, and identifying any supporting documentation that is required to be maintained by the account holder.

 Section 5F. (a) For the purposes of this section, the following words shall have the following meanings unless the context clearly requires otherwise:

  “Account holder”, an individual who establishes, individually or jointly with 1 or more other individuals, a first-time homebuyer savings account.

 “Allowable closing costs”, a disbursement listed on a settlement statement for the purchase of a single-family residence in the commonwealth by a qualified beneficiary.

 “Eligible costs”, the down payment and allowable closing costs for the purchase of a single-family residence in Massachusetts by a qualified beneficiary.

 “Financial institution”, any bank, trust company, savings institution, industrial loan association, consumer finance company, credit union, or any benefit association, insurance company, safe deposit company, money market mutual fund, or similar entity authorized to do business in the commonwealth.

 “First-time homebuyer”, an individual who resides in the commonwealth and has not owned or purchased, either individually or jointly, a single-family residence.

 “First-time home buyer savings account”, an account with a financial institution that an account holder designates as a first-time home buyer savings account on the account holder’s Massachusetts income tax return for tax year 2025 or any tax year thereafter, pursuant to this section for the purpose of paying or reimbursing eligible costs for the purchase of a single-family residence in the commonwealth by a qualified beneficiary.

 “Qualified beneficiary”, a first-time home buyer who is designated as the qualified beneficiary of an account designated by the account holder as a first-time home buyer savings account.

 “Settlement statement”, the statement of receipts and disbursements for a transaction related to real estate, including a statement prescribed under the Real Estate Settlement Procedures Act of 1974, 12 U.S.C. 2601 et seq., as amended, and regulations thereunder.

 “Single-family residence”, a single-family residence owned and occupied by a qualified beneficiary as the qualified beneficiary’s principal residence, which may include a manufactured home, trailer, mobile home, condominium unit, or cooperative.

 (b) Beginning January 1, 2025, any individual may open an account with a financial institution and designate the account, in its entirety, as a first-time home buyer savings account to be used to pay or reimburse a qualified beneficiary’s eligible costs for the purchase of a single-family residence in the commonwealth.

 (c) An account holder must designate, no later than April 15 of the year following the tax year during which the account is established, a first-time home buyer as the qualified beneficiary of the first-time home buyer savings account. The account holder may designate themselves as the qualified beneficiary and may change the designated qualified beneficiary at any time provided, however, there shall not be more than 1 qualified beneficiary at any time.

 (d) An individual may jointly own a first-time home buyer savings account with another person if the joint account holders file a joint income tax return; provided, however, this requirement shall not apply if at least 1 person would not otherwise be required to make a return because their Massachusetts gross income did not exceed $8,000.

 (j) A financial institution shall not be required to: (1) designate an account as a first-time home buyer savings account, or designate the qualified beneficiaries of an account, in the financial institution’s account contracts or systems; (2) track the use of funds withdrawn from a first-time home buyer savings account; (3) allocate funds in a first-time home buyer savings account among joint account holders or multiple qualified beneficiaries; or (4) report any information to the department of revenue or any other governmental agency that is not otherwise required by law.

 (k) A financial institution is not responsible or liable for: (1) determining or ensuring that an account satisfies the requirements to be a first-time home buyer savings account; (2) determining or ensuring that funds in a first-time home buyer savings account are used for eligible costs; or (3) reporting or remitting taxes or penalties related to the use of a first-time home buyer savings account.

 (l) Except as otherwise provided in this section and subject to the limitations under this subsection, there shall be deducted from taxable income of an account holder, for Massachusetts income tax purposes: (1) the amount contributed to a first-time home buyer savings account during each tax year, not to exceed $25,000 for an account holder who files an individual tax return or $50,000 for joint account holders; and (2) the amount of earnings, including interest and other income on the principal, from the first-time home buyer savings account during the tax year.

 (m) An account holder may claim the deduction and exclusion under subsection (k): (1) for a period not to exceed 15 years; (2) for an aggregate total amount of principal and earnings, not to exceed $250,000 during said 15-year period; and (3) only if the principal and earnings of the account remain in the account until a withdrawal is made for eligible costs related to the purchase of a single-family residence by a qualified beneficiary, except as otherwise provided in this section.

 (n) Any funds in a first-time home buyer savings account not expended on eligible costs by December 31 of the last year of the 15-year period shall thereafter be included in the account holder’s taxable income.

 (o) A person other than the account holder who deposits funds in a first-time home buyer savings account shall not be entitled to the deduction and exclusion provided for under this section.

 (p) The deduction and exclusion from taxable income provided for by this section shall apply to any alternative bases for calculating taxable income for Massachusetts income tax purposes.

 (q) Except as otherwise authorized in this of this section, if the account holder withdraws any funds from a first-time home buyer savings account for a purpose other than eligible costs for the purchase of a single-family residence: (1) said shall be included in the account holder’s taxable income; and (2) the account holder shall pay a penalty to the department of revenue equal to the tax that would have been collected had the withdrawn funds been subject to income tax.  Such penalty shall not apply to funds withdrawn from an account that were: (i) withdrawn by reason of the account holder’s death or disability; (ii) a disbursement of assets of the account pursuant to a filing for protection under the United States Bankruptcy Code, 11 U.S.C. § 101 et seq.; or (iii) a transfer of the funds from a first-time home buyer savings account to a new first-time home buyer savings account held by a different financial institution or the same financial institution.

 (r) The department of revenue shall prepare forms for: (1) the designation of an account with a financial institution to serve as a first-time home buyer savings account; (2) the designation of a qualified beneficiary of a first-time home buyer savings account; and (3) an account holder to annually submit to the department of revenue detailed information regarding the first-time home buyer savings account, including but not limited to a list of transactions for the account during the tax year, and identifying any supporting documentation that is required to be maintained by the account holder.”

Massachusetts Biomedical Initiatives

Messrs. Moore and O'Connor moved that the proposed new text be amended in section 2, by inserting after item 7007-0300 the following item:-

"7007-0500  For the operation and maintenance of the Massachusetts Biomedical Initiatives, Inc. for the commercialization of new, academic-based research and development and raising the scientific awareness of the communities of the commonwealth; provided, that the institute, in collaboration with the office of business development, shall expend not less than $250,000 for initiatives to increase diversity in the fields of life sciences and biotechnology in the commonwealth; provided further, that such initiatives may include, but shall not be limited to: (i) investments in minority-owned businesses; (ii) grants to school districts with significant minority student populations for the development of curricula, purchase of equipment and the provision of internships; (iii) planning and implementation of strategies to recruit, develop and retain a diverse workforce in the fields of life sciences and biotechnology; and (iv) identifying structural and cultural obstacles to the full inclusion of diverse population in the life sciences and biotechnology field, along with recommendations for removing those obstacles; provided further, that not later than January 31, 2025, the institute shall submit a report to the house and senate committees on ways and means on the development, implementation and success of these initiatives, including the disbursement of funds to specific entities as defined in this item; and provided further, that the institute shall seek out private funds necessary to match contributions equal to $1 for every $1 contributed by this item ....................... $750,000".

Commonwealth Competitiveness Commission

Messrs. Tarr and O'Connor moved that the proposed new text be amended by inserting after section ___ the following section:-

"SECTION XX. Notwithstanding any general or special law to the contrary, there is hereby established a special commission and study on the competitiveness of the Massachusetts economy. The commission shall investigate the high costs of conducting business in the Commonwealth, high costs of housing, rise of remote work, and the net out-migration of Massachusetts residents. The commission shall document recommended steps that should be taken to make Massachusetts economically attractive and competitive. The commission shall consist of the secretary of housing and economic development or a designee; 1 member of the house of representatives appointed by the speaker of the house of representatives; 1 member of the senate appointed by the senate president; 1 member of the house of representatives appointed by the minority leader of the house of representatives; 1 member of the senate appointed by the senate minority leader; 2 members appointed by the governor, 1 of whom shall be an individual with expertise in housing development and 1 of whom shall be an individual with expertise in business development; 2 members of the Massachusetts High Technology Council; 2 members of the Massachusetts Taxpayers Foundation; 1 member of the Citizens’ Housing and Planning Association (CHAPA); 1 member of the Massachusetts Growth Capital Corporation (MGCC); and 1 member of a chamber of commerce from each county, or a designee, appointed by the governor. The executive office of housing and economic development and its subdivisions shall provide technical support to the commission. The commission shall file its report and recommendations with the clerks of the house and senate, the house and senate chairs of the joint committee on economic development and emerging technologies, and the house and senate chairs of the joint committee on housing not later than June 30, 2027."

Lobstering Closure Mitigation

Messrs. O'Connor, Montigny and Tarr moved that the proposed new text be amended by inserting the following sections:-

"SECTION XX. Chapter 130 of the general laws is hereby amended by adding the following section:-

Section 37B. Lobstering Closure Mitigation Fund

(a) There shall be established and set up on the books of the Commonwealth, subject to appropriation, a fund to be known as the Lobstering Closure Mitigation Fund to be administered by the department of unemployment assistance.

(b) The purpose of the Fund shall be to provide financial assistance to lobstermen to mitigate the financial impacts of fishing area closures due to protection of endangered marine species as they work through the process of incorporation. For the purposes of this act, the term “lobsterman” shall mean a holder of a commercial fisherman permit (lobster) as so appearing in section 38 of this chapter that is deemed to be active and transferable by the director of marine fisheries, and the term “trap” shall mean a lobster tag used to catch lobsters that is owned by and licensed under and a lobsterman. Any lobsterman who is domiciled in Massachusetts shall be eligible for weekly payments equal to one dollar per lobster trap tag per week. Eligibility for said payments shall be available through January 1 and shall terminate on June 30 annually.

(c) There shall be credited to the Fund all amounts that are, by law, transferred or authorized to be transferred thereto or directed to be deposited therein, and all amounts received as gifts, grants, or contributions for the purposes of the Fund. Amounts credited to the Fund shall not be subject to further appropriation and any money remaining in the Fund at the end of a fiscal year shall revert to the General Fund.

(d) The director of the department shall report annually to the house and senate committees on ways and means and the joint committee on agriculture on income received into the fund and sources of that income, any expenditure from the fund and their purposes, and fund balances.

(e) The department shall promulgate regulations as necessary to implement the provisions of this section, including, but not limited to, regulations pertaining to payment application and disbursement procedures.

SECTION XX. The Secretary of State shall promulgate regulations to determine progress toward incorporation made by all recipients no later than January 1 annually.

(a) Lobstermen who are found to have not made sufficient progress toward incorporation after their first year of receiving closure mitigation payments shall not be eligible for further payments until such progress is made.

(b) The Secretary of State shall host an annual information session for lobstermen to educate recipients on the incorporation process and provide resources to assist with incorporation.

SECTION XX. 3 fiscal years after the effective date of this act, the Fund shall be dissolved.

SECTION XX. This act shall take effect on January 1st, 2027."

For a short-term housing bridge subsidy program to serve households with individuals who: (i) are not less than 60 years of age; (ii) reside in the commonwealth; (iii) are otherwise eligible for housing under items 7004-0107, 7004-9005, or 7004-9024; (iv) have incomes of not more than 80 per cent of the area median income; and (v) are at risk of eviction due to their inability to consistently pay rent; provided, that households participating in the program shall not, while receiving such assistance, be required to pay more than 30 per cent of their monthly adjusted income for rent, mortgage or other housing financial obligations; provided further, that not less than 75 per cent of the bridge subsidies shall be awarded to households with incomes at initial occupancy that do not exceed 30 per cent of the area median income; provided further, that each participating household shall not be required to pay more than 30 per cent of its monthly adjusted income for rent; provided further, that the executive office of housing and livable communities shall provide assistance for housing units equal to an amount of up to 110 per cent of the area or small area fair market rent based on unit size as established annually by the United States Department of Housing and Urban Development; provided further, that the executive office of housing and livable communities shall enter into performance-based contracts with designated agencies serving older adults to administer the program in urban, suburban and rural areas of the commonwealth; provided further, that the program shall be administered in coordination with the executive office of aging and independence; provided further, that the executive office of housing and livable communities shall provide quarterly reports to the house and senate committees on ways and means, the joint committee on elder affairs and the joint committee on housing on the implementation of the program; provided further, that such reports shall include, but not be limited to, the: (a) number of households screened for the program; (b) number of households approved for the program; (c) age, race, ethnicity, zip code and other demographic data on households approved for the program; (d) age, race, ethnicity, zip code and other demographic data on households deemed ineligible for the program; (e) total number of households participating in the program; (f) total number of households exiting the program and reasons for exiting; (g) number of households that transferred to another affordable housing program; and (h) average number of days that it takes for a household to utilize a bridge subsidy after receiving it; and provided further, that such reports shall be posted on the executive office of housing and livable communities’ website  …..…$7,500,000".

Section 16. The executive office of housing and livable communities, hereinafter referred to as EOHLC, shall, subject to appropriation, establish and administer an alternative housing voucher program in the form of either mobile vouchers or project-based vouchers for eligible and qualified low-income persons with a disability as determined pursuant to EOHLC regulations.

To be eligible for the alternative housing voucher program, an applicant shall: (i) be a low-income person with a disability, as determined by EOHLC and (ii) comply with all applicable EOHLC program eligibility regulations.

The executive office of housing and livable communities shall promulgate regulations and may issue guidelines or guidance materials, as it deems necessary, to administer the alternative housing voucher program. Such regulations, guidelines or guidance may include, but not be limited to: (i) income and asset requirements for applicant eligibility; (ii) requirements for program participants to pay a percentage of their income toward rent; (iii) methods for calculating payment standards and subsidy amounts and exemptions to payment standards deemed necessary by the executive office; (iv) administering the program through administrative agencies, which may include local and regional housing authorities and non-profit organizations and (v) conditions for program participation and termination.

Nothing stated herein shall give rise to enforceable legal rights in any party or an enforceable entitlement to any form of housing and further, nothing stated herein shall be construed as giving rise to such enforceable legal rights or such enforceable entitlement.”

Section 24. Public Hearing and Comment Period for Department of Public Utilities Rate Changes

(a) The Department of Public Utilities shall be required to hold at least one public hearing and a 30-day public comment period before approving any rate increase, including changes to delivery fees or other charges.

(b) The department shall provide notice of such hearings in a manner that ensures accessibility, including publication on the department’s website, written notifications to affected municipalities, and public service announcements.

SECTION 2. Chapter 164 of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by adding the following section:-

Section 149. Rate and Delivery Fee Increase Cap

(a) Notwithstanding any general or special law to the contrary, no investor-owned electric or gas distribution company shall increase delivery fees or rates by more than 3 percent per year, adjusted annually based on the Consumer Price Index for the Northeast region, as determined by the Bureau of Labor Statistics.

(b) The department shall adopt regulations necessary to implement this section, including provisions ensuring transparency in rate adjustments and consumer notifications.

SECTION 3. Said chapter of the General Laws, as so appearing, is hereby amended by adding the following section:-

Section 150. Veteran Utility Rate Reduction Program

(a) The department shall establish a Veteran Utility Rate Reduction Program that expands upon the existing tiered rate structure, specifically targeting veterans, as defined by section 1 of chapter 115, and those receiving VA disability compensation.

(b) The department shall ensure that eligible veterans receive utility delivery fee discounts contingent upon and aligned with the existing tiered low-income discount structure as established by the department, with veterans qualifying for equivalent or greater benefits under the same income thresholds.

(c) The department shall promulgate regulations necessary for the implementation of this section, ensuring that verification of eligibility for the veteran discount aligns with existing procedures for income-based discounts, utilizing VA records and other appropriate documentation. The department shall also conduct outreach efforts to maximize veteran participation in the program

SECTION 4. Said chapter of the General Laws, as so appearing, is hereby amended by adding the following section:-

Section 151. Senior Utility Rate Reduction Program

The department shall establish a utility rate reduction program for residents of the commonwealth aged 65 and older to provide discounted utility delivery fees. The department shall promulgate regulations to determine eligibility criteria, discount rates, and ensure streamlined implementation.

SECTION 5. Chapter 239 of the Acts of 2024 is hereby amended by striking out sections 4, 5, 10, 11, 16, 17, and 98.

SECTION 6. Notwithstanding any general or special law to the contrary, there shall be a special commission to study and recommend reforms to utility delivery fee structures, industry best practices, and cost-reduction measures for consumers in the Commonwealth. The commission shall analyze the impact of delivery fees on ratepayers, identify the primary cost drivers, and evaluate regulatory or market-based strategies to mitigate excessive charges while ensuring reliable service. The commission shall assess the impact of delivery fees on consumer costs, market competition, and energy affordability through a review of historical rate structures, policy comparisons with other states, stakeholder input, and financial modeling to identify potential reforms that could reduce costs while maintaining reliable service. Additionally, the commission shall review the effectiveness of existing regulations governing delivery fees and identify potential legislative or administrative adjustments to enhance pricing transparency and efficiency. The commission shall consist of the House and Senate chairs of the Joint Committee on Telecommunications, Utilities, and Energy, who shall serve as co-chairs; the Speaker of the House of Representatives or a designee; the President of the Senate or a designee; the House Minority Leader or a designee; the Senate Minority Leader or a designee; the Chair of the Department of Public Utilities or a designee; the Attorney General or a designee; one representative from the Massachusetts Municipal Association; one representative from the Massachusetts Competitive Energy Suppliers Association; and two individuals with expertise in utility regulation, energy pricing, or economic analysis to be appointed by the Governor. The commission shall hold no fewer than four public hearings to solicit input from stakeholders, including consumer advocacy groups, industry representatives, and regulatory agencies. The commission shall submit a report detailing its findings and recommendations, including any proposed legislation, to the House and Senate Committees on Ways and Means, the Joint Committee on Telecommunications, Utilities, and Energy, and the Clerks of the House of Representatives and Senate no later than twelve months after the passage of this legislation."

(d) An MBTA community shall be exempt from the requirements of this section if the community meets any of the following conditions:

(1) The state has not approved an increase in the town's water withdrawal permit necessary to support additional housing development;

(2) The community has more than 15 percent of its existing housing stock classified as low or moderate-income housing as defined in Section 20 of Chapter 40B;

(3) The community lacks basic infrastructure or sufficient state funding for infrastructure improvements, including but not limited to the absence of municipal water or sewer systems;

(4) The majority of the designated development zone consists of green space or protected natural resources, including nature preserves as defined in section 1 of chapter 131; or

(5) The community has a population of fewer than 8,000 residents, as determined by the most recent federal census.

The Executive Office of Housing and Livable Communities shall promulgate regulations to enforce this subsection, including procedures for communities to apply for exemptions."

Small Business Support and Fee Reform

Mrs. Dooner, Ms. Edwards and Mr. O'Connor moved that the proposed new text be amended by inserting after section __ the following new section:—

"SECTION __. SECTION 1. For the purposes of this act, “Small business” shall mean a business entity, including its affiliates, that (a) is independently owned and operated; (b) has a principal place of business in the commonwealth; and (c) would be defined as a ''small business'' under applicable federal law, as established in the United States Code and promulgated from time to time by the United States Small Business Administration.

SECTION 2. Chapter 30A of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by adding the following section:

Section 26. Small Business Administrative Rights.

(a) All state agencies shall respond to inquiries, requests for information, or other correspondence from small businesses within 24 hours of receipt, excluding weekends and state holidays.

(b) State agencies shall notify small businesses by email of any pending rule changes, compliance requirements, or other regulatory updates no later than 7 days after such changes are published.

(c) Small businesses shall have the right to a hearing within 30 days of a request to contest violations, penalties, or other adverse actions. Agencies shall provide clear written explanations of any alleged violations, including citations to applicable laws or regulations.

(d) State agencies shall provide accessible and plain-language instructions to assist small businesses, in achieving compliance with state regulations. No penalties shall be issued for noncompliance unless the small business is given a reasonable time to rectify the issue, as determined by the agency's rules.

SECTION 3. Chapter 62C of the General Laws, as appearing in the 2022 official edition, is hereby amended by adding the following section:

Section 19A. One-Year Waiting Period for New Taxes on Small Businesses.

(a) Any new tax, fee, or financial charge on small businesses shall not take effect until one year after it is enacted.

(b) The Department of Revenue must notify all affected small businesses in writing at least six months before the new tax or fee takes effect. The notice must include: (1) The law or regulation creating the tax or fee; (2) A plain-language summary of its purpose and requirements; And (3) Instructions for how to appeal.

(c) Small businesses may appeal the new tax or fee within 30 days of receiving the notice. The Department of Revenue must hold a hearing within 60 days and provide a written decision within 30 days after the hearing.

(d) This waiting period may be waived only during a declared state of emergency if the Governor and two-thirds of both legislative chambers approve.

SECTION 4. Chapter 93 of the General law, as appearing in the 2022 official edition, is hereby amended by adding the following section:-

Section 115. Centralized Permitting and Licensing Portal for Small Businesses.

(a) The Secretary of the Commonwealth, in coordination with the Executive Office of Health and Human Services, Executive Office of Economic Development, the Executive Office of Energy and Environmental Affairs, and other relevant state agencies, shall establish and maintain a centralized online portal to streamline licensing, permitting, and registration processes for small businesses, within the Commonwealth.

(b) The portal shall: (1) Provide a unified platform for applying, renewing, and tracking compliance for licenses and permits; (2) Include licensing and permitting requirements from all relevant state agencies, boards, and commissions; (3) Offer comprehensive guidance and resources to help small businesses meet compliance requirements; (4) Facilitate secure online payments for applicable fees;(5) include the capability for real-time tracking of permit and license applications, allowing users to monitor the status, progress, and any outstanding requirements in real time; and (6) Include a feedback mechanism for users to report issues or suggest improvements.

(c) Each agency, board, and commission overseeing licensing or permitting processes for small businesses shall collaborate with the Secretary of the Commonwealth to integrate their processes into the portal within 12 months of the effective date of this section.

(d) The Secretary of the Commonwealth shall adopt regulations to implement this section, including timelines for agency integration and performance benchmarks for the portal.

(e) The Secretary shall submit an annual report to the Governor, the Speaker of the House, the Senate President, the Minority Leaders of both chambers, and the Chairs of the Joint Committee on Community Development and Small Businesses. This report shall detail the portal's operations, usage statistics, and provide any recommendations for improvement.

SECTION 5. Section 9-525 of Chapter 106 of the General Law, as so appearing, is hereby amended by adding the following subsection:-

(e) Small business fee reduction. Notwithstanding any general or special law to the contrary, the fees specified in subsections (a), (b), and (c) of this section shall be reduced by 50 percent for entities classified as small businesses. The Secretary of the Commonwealth shall promulgate regulations to implement this fee reduction.

SECTION 6. Section 45 of Chapter 108A of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by inserting after paragraph (1) the following paragraph:-

Notwithstanding any general or special law or rule or regulation to the contrary, the registration fee for entities classified as small businesses, shall be 250 dollars.

SECTION 7. Said section of chapter 108A of the General Laws, as so appearing, is hereby amended by inserting after paragraph (3) the following paragraph:-

Notwithstanding any general or special law or rule or regulation to the contrary, the annual report fee for entities classified as small businesses, shall be 250 dollars.

SECTION 8. Section 13 of chapter 109 of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by adding the following subsection:-

(c) Notwithstanding any general or special law or rule or regulation to the contrary, the filing fees for certificates of limited partnership, certificates of amendment, certificates of cancellation, and judicial decrees of amendment or cancellation shall be reduced by 50 percent for entities classified as small businesses. The Secretary of the Commonwealth shall promulgate regulations to implement this fee reduction.

SECTION 9. Said section of chapter 109 of the General Laws, as so appearing, is hereby amended by adding the following subsection:-

(d) Notwithstanding any general or special law to the contrary, the annual report fee for limited partnerships shall be reduced by 50 percent for entities classified as small businesses.

SECTION 10. Chapter 112 of the General Laws, as so appearing, is hereby amended by adding after section 289, the following section:-

Section 290. Reduction of Professional Licensing Fees for Small Businesses.

Notwithstanding any general or special law to the contrary, all fees required under this chapter for obtaining, renewing, or reinstating professional licenses shall be reduced by 50 percent for individuals classified as small business owners. Each licensing board shall promulgate regulations to implement this reduction and ensure consistency across professions.

SECTION 11. Section 114 of chapter 156B of the General Laws, as so appearing, is hereby amended by adding the following paragraph at the end:-

Notwithstanding any general or special law to the contrary, all fees required under this section shall be reduced by 50 percent for entities classified as small businesses. The Secretary of the Commonwealth shall promulgate regulations to implement this fee reduction.

SECTION 12. Section 2B of Chapter 141 of the General Laws, as so appearing, is hereby amended by inserting after the first paragraph the following paragraph:-

Notwithstanding any general or special law to the contrary, the fees required under this section for licenses, examinations, and renewals shall be reduced by 50 percent for individuals classified as small business owners. The Board of State Examiners of Electricians shall promulgate regulations to implement this reduction.

SECTION 13. Section 5 of chapter 142 of the General Laws, as so appearing, is hereby amended by inserting after the first paragraph the following paragraph:-

Notwithstanding any general or special law to the contrary, the fees required under this section for licenses, examinations, and renewals shall be reduced by 50 percent for individuals classified as small business owners. The Board of State Examiners of Plumbers and Gas Fitters shall promulgate regulations to implement this reduction.

SECTION 14. Section 12 of chapter 156C of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by striking subsection (d) and inserting in place thereof the following:-

(d) The fee for the filing of the certificate of organization required by subsection (a) shall be 250 dollars. The fee for the filing of the annual report required by subsection (c) shall be 250 dollars. Such fees shall be paid to the state secretary at the time the certificate of organization or the annual report is filed.

SECTION 15. Section 1.22 of chapter 156D of the General Laws, as appearing in the 2022 Official Edition, is hereby amended by inserting the following paragraph:-

Notwithstanding any general or special law or rule or regulation to the contrary, fees under this section shall be reduced by 50 percent for small businesses. The commissioner shall issue regulations to implement this provision.

SECTION 16. Notwithstanding any general or special law to the contrary, to the extent feasible any boards or commission created regarding excise policy shall have at least one member that represents small business in the commonwealth."
