AN ACT FURTHER REGULATING THE OPERATION OF A MOTORCYCLE.
Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
Section 1 of chapter 90 of the General Laws is hereby amended by striking
out the definition of "Motor cycle", as most recently amended by section 1
of chapter 261 of the acts of 1976, and inserting in place thereof the
"Motorcycle", any motor vehicle having a seat or saddle for the use of
the rider and designed to travel on not more than three wheels in contact
with the ground, including any bicycle with a motor or driving wheel
attached, except a tractor or a motor vehicle designed for the carrying of
golf clubs and not more than four persons, an industrial three-wheel truck,
a motor vehicle on which the operator and passenger ride within an
enclosed cab, or a motorized bicycle.
The first paragraph of section 7 of said chapter 90, as most recently
amended by section 1 of chapter 653 of the acts of 1983, is hereby further
amended by adding the following sentence:- No person operating a
motorcycle shall permit any person to ride as a passenger, unless such
motorcycle is designed to carry more than one person; and no person
operating a motorcycle shall permit a passenger to ride in front of said operator.
