Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
Section 9 of chapter 94C of the General Laws, as appearing in the 1984 Official Edition, is hereby amended by inserting after subsection (b) the following subsection:-
(b?) Notwithstanding the provisions of subsection (b) and section seventeen, a physician, when acting in good faith and providing care under a program funded in whole or in part by 42 USC 300, or a nurse authorized by said physician, may lawfully dispense controlled substances pursuant to schedule VI of section three to recipients of these services in such quantity as needed for treatment, and shall be exempt from the requirement that such dispensing be in a single dose or as necessary for immediate treatment. The department may establish rules and regulations controlling the dispensing of said medications, including but not limited to the types and amounts of medications dispensed and appropriate safeguards for dispensing.
