AN ACT AUTHORIZING THE CITY OF LOWELL TO APPROPRIATE MONEY FOR THE PAYMENT OF AND TO PAY A CERTAIN UNPAID BILL.
Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. The city of Lowell is hereby authorized to appropriate
for the payment of, and after such appropriation the treasurer of said city
is hereby authorized to pay, to Barretto Granite Corp., a corporation
organized under the laws of New Hampshire,
an unpaid bill incurred by said city in the amount of eighteen thousand five
hundred dollars, said bill being legally unenforceable against said city and
as are certified for payment by the department of veterans' services wherein
said bill was contracted; provided, that the money so appropriated to pay
such said bill shall be raised by taxation or made available from the
unappropriated surplus funds of the city.
SECTION 2. No bill shall be approved by the auditor of said city
for payment or paid by the treasurer thereof under the authority of this
act unless and until a certificate has been signed and filed with said
auditor, stating under the penalties of perjury that the services and
supplies for which said bill has been submitted were ordered by an official
or an employee or agent of said city and that such services and supplies
were rendered to said city or official or agent.
SECTION 3. Any person who knowingly files a certificate required
by section two which is false, and who thereby receives payment for
services which were not rendered to said city, shall be punished by
imprisonment for not more than one year or by a fine of not more than three
hundred dollars, or both.
SECTION 4. This act shall take effect upon its acceptance by the
city of Lowell during the current year.
