AN ACT AUTHORIZING THE TOWN OF FRANKLIN TO APPROPRIATE MONEY FOR THE PAYMENT OF AND TO PAY A CERTAIN UNPAID BILL.
Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. The town of Franklin is hereby authorized to
appropriate for the payment of, and after such appropriation the treasurer
of said town is hereby authorized to pay, to Bell's Roofing Co. Inc., an
unpaid bill incurred by said town and totalling fourteen thousand seven
hundred twenty dollars, said bill being legally unenforceable against said
town and as is certified for payment by the school department of the town
of Franklin wherein said bill was contracted; provided, however, that the
money so appropriated shall be paid by the school department or made
available from the unappropriated surplus funds of the town.
SECTION 2. No bill shall be approved by the town comptroller of
said town for payment or paid by the treasurer thereof under the authority
of this act unless and until a certificate has been signed and filed with
said town comptroller, stating under the penalties of perjury that the
services and supplies for which said bill has been submitted were ordered
by an official or an employee or agent of said town and that such services
and supplies were rendered to said town or official or agent.
SECTION 3. Any person who knowingly files a certificate required
by section two which is false, and who thereby receives payment for
services which were not rendered to said town, shall be punished by
imprisonment for not more than one year or by a fine of not more than three
hundred dollars or both.
SECTION 4. This act shall take effect upon its passage.
