Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. The school committee of the city of Lawrence and the school committee of the town of Andover are hereby authorized to enter into an agreement for the establishment, operation and maintenance of a collaborative school. Such agreement may contain provisions concerning the powers, duties and composition of a collaborative school committee, the election or appointment of officers by such committee, including a treasurer who may but need not be the treasurer of a member municipality of the collaborative, the nature of the educational programs to be offered by the collaborative school, including special classes and programs to be paid for on a tuition basis, the formulation and approval of capital and operating budgets for the collaborative school and the apportionment and payment of the capital and operating costs included therein, the incurring of debt on behalf of the collaborative school to finance capital costs, the assignment of personnel to the collaborative school, and the amendment from time to time of the agreement, including amendments for the purpose of admitting new member municipalities to the collaborative. Such agreement may also contain such other provisions as may be necessary or appropriate from time to time for the operation of the collaborative school.
SECTION 2. The agreement authorized in section one shall take effect upon approval by the commissioner of education and by majority vote at a town meeting in the town of Andover and by majority vote of the city council in the city of Lawrence.
SECTION 3. Student enrollment at the collaborative school shall be voluntary. The school committee of the collaborative school, the commonwealth, or any city or town which is a member of the collaborative school shall not assign a student to the collaborative school without the express consent of a parent or guardian of such student.
SECTION 4. The land and the buildings and improvements thereon comprising the collaborative school shall be owned by the city of Lawrence and the town of Andover and, upon the admission of new members to the collaborative, by said city and town and by such new members, as joint tenants.
SECTION 5. State financial assistance provided by chapter seventy-one of the General Laws shall be calculated and paid to the treasurer of the collaborative school as if the collaborative school were a regional school district. In addition, financial assistance provided by chapter seventy of the General Laws shall be calculated and paid to the treasurer of the collaborative school based upon a school aid percentage which shall be equal to the school aid percentage for the city of Lawrence as determined in accordance with said chapter seventy.
SECTION 6. This act shall take effect upon its passage.
