Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. The deputy commissioner of the division of capital planning and operations is hereby authorized, subject to the provisions of sections forty E through forty J, inclusive, of chapter seven of the General Laws, to convey by deed approved as to form by the attorney general a permanent easement over land located at the Belchertown state school, to the town of Belchertown, subject to the requirements of sections two, three and four and to such terms and conditions as the deputy commissioner may prescribe, in consultation with the department of mental retardation said easement being described as follows:
Beginning at a point on the southerly sideline of George Hannum Street, said point being N.85 degrees 48' 10" W. a distance of 5.04 feet from the westerly terminus of the southerly sideline of Jackson Street at its' intersection with the southerly sideline of George Hannum Street;
Thence running N.85 degrees 48' 10" W. along the southerly sideline of George Hannum Street a distance of 55.27 feet to a point;
Thence, running S.34 degrees 35' 38" W. a distance of 862.57 feet to a point;
Thence, running N.65 degrees 32' 18" W. a distance of 64.44 feet to a point at the approximate centerline of an existing twelve foot wide gravel access road;
Thence, running S.24 degrees 27' 42" W. along the centerline of the access road a distance of 20.00 feet to a point;
Thence, running S.65 degrees 32' 18" E. a distance of 60.87 feet to a point;
Thence, running S.34 degrees 35' 38" W. a distance of 39.21 feet to the northeast corner of an existing sewage treatment plant;
Thence, running S.36 degrees 51' 40" E. along the treatment plant a distance of 30.97 feet to a point;
Thence, running N.35 degrees 41' 12" E. a distance of 55.00 feet to a point;
Thence, running S.54 degrees 18' 48" E. a distance of 5.00 feet to a point;
Thence, running N.35 degrees 41' 12" E. a distance of 20.00 feet to a point;
Thence, running N.54 degrees 18' 48" W. a distance of 5.00 feet to a point;
Thence, running N.35 degrees 41' 12" E. a distance of 885.08 feet to the point of beginning.
Said easement contains 37,518 square feet of land, more or less, and lies entirely on land of the Commonwealth.
The above-described easement is shown on plan marked "Plan of Proposed Sanitary Sewer Easement in Belchertown, Massachusetts" dated May 11, 1988.
SECTION 2. No deed conveying by or on behalf of the commonwealth the easement described in section one shall be valid unless such deed provides that said easement shall be used for the purpose of laying, maintaining, repairing, replacing, and using one or more sanitary sewer lines and related sewerage treatment facilities.
SECTION 3. If the aforementioned purpose as described in section two ceases at any time, said easement shall revert to the commonwealth under such terms and conditions as the deputy commissioner shall prescribe.
SECTION 4. The town of Belchertown shall assume the costs of any appraisals, surveys, and other expenses as deemed necessary by the deputy commissioner for the granting of this easement.
