Whereas, The deferred operation of this act would tend to defeat its purpose, which is to immediately provide for the extension by the metropolitan district commission of certain leases, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. The deputy commissioner of the division of capital planning and operations is hereby authorized, subject to the provisions of section forty E and sections forty I to forty J, inclusive of chapter seven of the General Laws, to lease to the President and Fellows of Harvard College for a term not to exceed ninety-nine years certain real property located in the city of Cambridge, subject to the requirements of sections two, three, four, five and six and to such additional terms and conditions as the deputy commissioner may prescribe, in consultation with the metropolitan district commission, said property being described in the lease and as shown on a plan entitled "Plan of Land in Cambridge" dated January 2, 1907, recorded with the southern district registry of deeds in the county of Middlesex in Plan Book 165, Plan 2.
SECTION 2. No lease of the property described in section one shall be valid unless such lease provides that said property shall be used for the purpose of rowing programs and other related purposes.
SECTION 3. Said lease is an extension of a certain lease for the aforementioned property, dated January 2, 1907, and recorded with the registry of deeds in the county of Middlesex in Book 3278, Page 267, between the commonwealth, as lessor, and the trustees of a trust established under declaration of trust dated February 26, 1890, recorded with southern district registry of deeds in said county in Book 1961, Page 61, as lessee, for an additional term of ninety-nine years. The additional term shall commence on June twenty-first, two thousand and five and expire on June twentieth, two thousand one hundred and four.
SECTION 4. The consideration paid for the lease of the aforementioned described property shall include the conveyance to the commonwealth, in fee simple, of the property known as "Blair Pond" consisting of two contiguous parcels shown as "Lot A" and "Lot B" on a plan entitled "Subdivision Plan of Land in Belmont & Cambridge, Massachusetts," dated September 18, 1968, and recorded with the southern district registry of deeds in Book 11578, page 176, such parcels are more particularly described as follows:
Lot A. A certain parcel of land in the city of Cambridge and the town of Belmont, Middlesex County, Massachusetts, shown as Lot A on the plan and is bounded and described according to the plan as follows:
NORTHWESTERLY by land of owners unknown, Flanders Road as extended, and other land of owners unknown by three courses, 163.30 feet, more or less, 36.29 feet and 70.01 feet respectively;
SOUTHWESTERLY by land of owners unknown, 349.65 feet;
SOUTHERLY by land of owners unknown, 281.81 feet;
EASTERLY by Lot B as shown on the Plan, 451.39 feet; and
NORTHERLY by land now or formerly of the Boston & Maine Corp., 193.06 feet.
The parcel conveyed contains + 155,259 square feet according to the Plan.
Lot B. A certain parcel of land in the city of Cambridge, Middlesex County, Massachusetts, shown as Lot B on the Plan and is bounded and described according to the Plan as follows:
WESTERLY by Lot A as shown on the Plan, 451.39 feet;
NORTHERLY by land now or formerly of Boston & Maine Corp., 367.76 feet;
EASTERLY by land of owners unknown and by the end of Mooney Street as shown on the Plan, 651.92 feet;
SOUTHERLY by Lots 8 and 7 as shown on the Plan and by land of owners unknown, 100.15 feet;
NORTHWESTERLY by land of owners unknown, 302.22 feet; and
SOUTHEASTERLY by land of owners unknown, 247.93 feet; but excluding from Lot B a strip of land one foot wide and forty feet long at the northerly end of Normandy Terrace, said strip was conveyed to the city of Cambridge by deed of John T. Spinelli recorded with the southern district registry of deeds in the county of Middlesex in Book 11529, page 318.
The second parcel contains + 153,526 square feet.
SECTION 5. The President and Fellows of Harvard University shall assume the costs of appraisals, surveys, environmental studies and other expenses as deemed necessary by the deputy commissioner for the lease of the Weld Boathouse property.
SECTION 6. In the event that the aforementioned purpose described in section two ceases at any time, the lease shall be terminated under such terms and conditions as the deputy commissioner may prescribe.
SECTION 7. The metropolitan district commission is hereby authorized to renew its current lease with the American Legion, Marsh Post, 442 in the city of Cambridge, for a term not to exceed fifty years, of a building known as Gerry's Landing Bathhouse situated on Memorial drive extension in said city of Cambridge, in accordance with such terms and conditions as may be acceptable by the division of capital planning and operations in consultation with the metropolitan district commission. Said building is shown on a plan on file with the metropolitan district commission, parks engineering and construction division, entitled construction plans for Roadway Eliot Bridge to Arsenal Street Accession Number 37991-X, dated July 8, 1959, and revised April 1, 1964.
