Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. Chapter six hundred and nine of the acts of nineteen hundred and eighty-six is hereby repealed.
SECTION 2. The deputy commissioner of the division of capital planning and operations, acting for and on behalf of the commonwealth, subject to the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws subject to the requirements of section three of this act and such additional terms and conditions as the deputy commissioner may prescribe in consultation with the metropolitan district commission and the Massachusetts Water Resources Authority and subject to all rights, privileges and easements of record is hereby authorized to lease for a term of twenty-five years, certain land located in the towns of Needham and Wellesley to Babson College.
Said land is shown on a plan dated December 31, 1987 and entitled, "Commonwealth of Massachusetts, Metropolitan Water Works, Sudbury Aqueduct Land Plans", Scale 100 feet to an inch, Desmond Fitzgerald, Engineer, which Plan was recorded on January 1, 1898 as Plan No. 923"D", Plan Book 20, and is designated as Parcel 9 in an instrument of taking dated January 1, 1898, and recorded with Norfolk registry of deeds in Book 805, Page 121.
SECTION 3. Babson College shall assume all costs for appraisals, surveys, and other expenses as deemed necessary by said deputy commissioner for the leasing of said property.
SECTION 4. In the event the property is not used for the purpose described in section two within five years of the effective date of this act, or if the use for the aforementioned purposes ceases at any time, the property shall revert to the commonwealth under such terms and conditions as said deputy commissioner may prescribe.
